Re: fda regulations

This post/reply (full reply below) was taken from the post above by Herbal Cutie (she has apparently edited her post and removed it, and then changed the subject line to "Thank you! n/m").  It originally contained the subject line: "fda regulations" .  I have pasted the content of the original post that used to be there, inset directly below.

"The only successful natural healer that I know of that died a natural, death was Dr. Christopher"

Hmmm...I was under the impression that Dr. Christopher was in a coma for some time before he finally died, I'm not so sure that is a natural death?

http://www.associationofmasterherbalists.co.uk/?id=176

"Sadly as a man no longer very young, John Christopher tripped over a boulder covered by snow and stayed in a coma for 6 months before dying in 1983, this legacy is literally that he reached tens of thousands more people than he ever could in his humble practice."

I appreciate the diplomatic approach in your response. But...

"here's what I did (always using Google advanced so I can type in phrases and words that I do NOT want). I typed in various combinations like: --FDA, herb, lawsuits--,--FDA persecutes + herb ***--,--herb,disclaimers--, that kind of thing. Then from the search results, I'd study every story I could find, and then use the information I gleaned from that, to create new & better searches...until I was confident I had what I needed/wanted."

OK, so what are you confident of? Can you anser just these simple questions for me now:

1) What simple guidelines are there for the label, for instance.

2) Do you need to be, or are you, inspected by the Health Department on a regular basis?

3)Do you need a license to sell in your town?

You are on a forum with hundreds of thousands of hits. This forum generates sales of your products. I have seen you give detailed answers to people over and over again. So surely, as a forum owner, business owner, and maker of these products, you can answer the three questions above?

Thank you.

Greetings -

"Sadly as a man no longer very young, John Christopher tripped over a boulder covered by snow and stayed in a coma for 6 months before dying in 1983, this legacy is literally that he reached tens of thousands more people than he ever could in his humble practice."  I'm aware of the cause of Dr. Christopher's death, he fell, hit his head, went in & out of a coma and died.  That's what I consider a natural dealth.  As in, a death not caused (or significantly 'hurried' or worsened) by those that persecute healers.

If you are the same person that emailed me recently, check your email - because I did take the time to more fully respond to your question (and I rarely EVER answer any questions, except those regarding orders) via email or PM.

I appreciate the diplomatic approach in your response. But...  My response was not meant to be "diplomatic" in any way, shape or form; it was meant to be informative and give you information (that I did not have when I started) so that you could research, learn and educate yourself...rather than relying upon someone else for decisions that can drastically affect your life.  That's called caring...it would have been substantially more simple to just write a few sentences and let you crash & burn because you didn't build your own knowledge base and a solid foundation for your business.

Give a man a fish, feed him for a day - teach a man to fish, feed him for a lifetime.  (it's easier to give a man a fish).

OK, so what are you confident of? Can you anser just these simple questions for me now:  :::shaking head and laughing:::  you don't seem to grasping the gist of what I'm trying to impart.  Let's try again :)

1) What simple guidelines are there for the label, for instance.  Look on the internet, do the searches, you find a zillion different 'experts' saying a zillion different things.  The only way you can choose wisely is by building yourself a solid foundation of knowledge that you can live with, feel confident, with and depend upon.

2) Do you need to be, or are you, inspected by the Health Department on a regular basis?  I know the answer to this - but it's EASY for you to find out, and it's not my responsibility to tell you things you can learn by yourself.  Here's a link to Google Advanced: http://www.google.com/advanced_search?hl=en where you can find the answers you are looking for, for your city/county/state.  And if that information isn't online, you can find a online phone book on Google and call around and find out which regulatory agency in your particular city/county/state you should call to find the answers to your questions.

Good heavens woman, is this the way you're going to decide how to make your herbal formulas? Or what dosages to suggest? Or how to respond (legally and ethically) when someone has an allergic reaction? or a severe healing crisis? or a drug interaction?  ...by asking and depending upon someone you've never even met on Curezone?  If you want to be successful at anything, you have to build your own foundation.  If I tell you the answers that you should be finding, learning & understanding, then I'm cheating & hurting you!  I wouldn't do that to anyone I'm helping with their health (or with anything else), whether I know them personally or not.

3)Do you need a license to sell in your town? Do you need a license?  Here's a freebie - Google "selling herbs" + FDA, and a complete and informative answer is on the first page of results (plus a LOT of other stories you definitely need to read about herbalists that have been arrested).  Why they were arrested directly impacts your life.  You'd better know EVERY word & reason before you ever put a label on a bottle!

>>>OK, so what are you confident of? <<<   What I am extremely confident of is that IF you obey "the letter of the law" (if there was a definitive "law"), you will always be at risk.  Because if ONE person goes to their doctor or the hospital with ANY symptoms, and they fill out the forms correctly (telling what herbs or supplements they are taking), and if the doctor thinks they had an "adverse reaction", that doctor is REQUIRED BY LAW to gather any/all information regarding the product AND the seller and immediately report it to the FDA.  It doesn't matter WHAT you put on the label, WHAT license you may or may not have, nor whether or not you had any city, country, state or federal agency inspect your home.  You HAVE to have built yourself a VERY solid foundation of knowledge so that you'll know what to do if/when that happens.

You are on a forum with hundreds of thousands of hits. This forum generates sales of your products. I have seen you give detailed answers to people over and over again. So surely, as a forum owner, business owner, and maker of these products, you can answer the three questions above?  Done.  But, lol, you do realize I hope, that you are asking a small business owner to tell you everything they spent long "weeks worth of hours learning" (that cost thousands of dollars worth of "time off" from my other small business), to give that information to you publicly, for nothing...and if I were anybody but who I am (and didn't care about your future as a fellow herbalist and human being), I would have laughed in your face (and some would have told you to go screw yourself), LONG before now.

Just fyi, 5 days ago I decided get my sleeping pattern back on the right track by moving forward a few hours at a time...so each day I stayed up for 18-22 hours and slept very little (and I still didn't even come CLOSE to catching up on my posts or those I'm personally counseling that have life-threatening diseases that are on the full IP).  Yesterday I finally got my back to a healthy schedule, but today I was overwhelmed by people who truly NEED my time & assistance....so once again, I've been awake for 20 hours.  And yes, that's my choice, and one I'm happy to make.  So, 45 minutes ago I clicked on the forum for one last look so I could organize "tomorrow" as I was falling asleep, and I saw this post.   And I took the time to answer it, explain my reasoning respectfully, with the best/most help I know how to offer you  (as I already had in what I'm fairly certain was an email from you) ...even when there are countless people that could be getting 'health responses' instead.   I answered because I care; I answered because I'm very worried about you (because it's obvious to me that it doesn't seem like you have ANY idea what you're getting into), and because the world needs more well-grounded, knowledgeable herbalists with quality products.

So, I'm asking you to understand why I won't be responding to any more of your requests.  If you want to do your homework, research fully and "dig in deep", and you run across things you can't make sense of no matter how you try, then if you post your dilemma I will do my best to help you (but not at the expense of someone elses health).  I have not borrowed money from you nor am I indebted to you for any favors - I don't owe you anything.  I am not an herbal business consultant - if I were, you would have prepaid me $125 an hour for what I've told you already.  And I am certainly NOT going to go against my own personal ethics & integrity and cheat you out of building a solid foundation for yourself.  Whether you know it (or believe it) or not - the rest of your entire life can be adversely affected (possibly extremely) by the choice to make & sell herbs; and that's something I learned completely & thoroughly LONG before I ever put a label on a bottle.  The best and most caring, heartfelt gift I can give you is to encourage/insist that you learn for yourself.

Thank you.  You're welcome.

Uny

Just in case you were not the person that I responded to via email, here is a copy for you (with name, email and other personal comments removed for privacy:

Ok, I'm convinced. After being a lurker at your forum for a while, I am ready to start making some simple formulas and helping others. But the only thing that kinda worries me is FDA approval. Is there a law or loophole I can learn about so that I do not get shut down by an overzealous government guy? :(

Do I have to be inspected if I offer these handmade products for sale to the public? Is there a title or name I can call my business so that I do not have to look over my shoulder everytime I make some kidney formula?

I'm guessing that you're "Herbal Cutie" - but whether or not you are, my best answers are here:
http://curezone.com/forums/am.asp?i=1578433.

By the way, there's nothing even remotely similar to "FDA approval" - and the risk is far more than just some overzealous 'government guy'.  Just doing it will point neon arrows to you, no matter what you name your business.  The government has already (since the beginning of the internet) recorded/logged every email you've ever sent and every website/search you've ever made (as well as all digital/cell phone conversations).

You don't seem to be very knowledgeable about what I refer to as 'conspiracy realities' and what you're actually up against.  One of the best starting places to gain some 'reality knowledge' are these two sites:
WHALE   Educate-Yourself.org - Natural Healing Therapies, Hidden Science, the New World Order, World Wide Electronic Mind Control, Population Reduction, and possible Earth Changes

(of course, the above two sites are not completely factual/correct, because no person but the PTB can know everything.   For starters, just learn to recognize all the valid puzzle pieces and then start putting them together, and you'll start seeing the complete picture.  After you've got that, then it's far easier to discern what is real and what is 'fear tactics').

Also, you need to read this (it's VERY long, detailed and well-documented) - but you don't need to read from the beginning, just scan down on the timeline to around 1860/75 and read 'to the present' will help you understand what it seems like you're seriously needing to know & understand:
The Medical Racket

Also, just so you know - I rarely answer non-order questions via email (if I did, I'd never have time for the forum...and I'd end up answering the same question thousands of times), so if you have further questions, please post them on the forum.

Healthiest of blessings,

Unyquity
