2 hrs ago S.1082 is an awful bill. Oppose it loudly. If this bill gets in force the FDA will have the power it needs to do away with vitamins, herbs, and the like. When you are writing to your Senators tell them that the Grassley bills, S467 and S468 are the ones that offer true reform of the FDA.

Amendment to Bill S1082: The Food and Drug Administration Revitalization Act
Purpose of the amendment:
The bill, S1082: The Food and Drug Administration Revitalization Act, is hereby amended to eliminate any reference to the terms food or food ingredients, such that food and food ingredients will not be subject to any jurisdiction or control by the Regan-Udall Foundation for the Food and Drug Administration.
Intent of amendment:
To eliminate from the bill any possibility that food or food ingredients would be treated like drugs either for safety review purposes or for assessment of their efficacy. It is a fundamental tenet of food and drug law that foods and food ingredients are presumed to be safe and
have to be established to be adulterated only if they present a significant or unreasonable risk of illness or injury.
WHAT TO DO: Flood Hatch, Harken and EVERY member of the Senate with a mssg asking them to kill S.1082 or at the VERY LEAST to amend S.1082 to include this amendment!!
Killing the bill could be impossible because it contains PDUFA (Prescription Drug User Fee Act) which is up for renewel every year. This is a HORRIBLE bill, and it should be killed, but it has a HUGE head of steam behind it ..... but if Hatch and Harkin don't even TRY to help us get this amendment...... then they will have sold their souls and tossed DSHEA into the trash.... and we can't just LET them do that....... I suggest that the 'good attorney' do more' .... 'pro bono' and fact check the data that has been put forth by Dr. Rima Laibow... that comment from the movie w/ tom hanks about ...'chained together at the bottom of the ocean..' comes to mind.... me thinks the good doc mercola was 'duped'.... despite the fee... and getting 'good advice'

This is a reply to # 857,923It doesn't take a lawyer to interpret the proposed rule change. I perceive he wasted his money, if he did in fact pay for an opinion. Just because someone charges $ 500 an hour doesn't mean they are correct. If my billing rate today is $ 600 an hour, the recipient would certainly like to believe they are getting good advice, but this is not necessarily the case.

Mercola is a Dr. is he not?
I have not read or read into the FDA jargon yet, but I am not ready to be placated by some pronouncement by a member of that club-- however removed from the mainstream-- before actually investigating what the watchdogs are barking about.
Any top professional lawyer charges that much.
He undoubtedly asked them to address the issue from the stance of a doctor's practice, and not of how that would be affecting you and me.
The watchdogs barking are a symptom disturbing the peace that we would like to naturally return to a normal peaceful state...
...to do this without actually getting to the bottom of the whole issue can be half baked-- with us falling prey to simply following through the motions of a knee jerk of the return of the knee that first swung up-- and now returns in a reflex action.
Our reflexes are invaluable when alerted to danger. They are also capable of being predictably engineered around by advanced operatives. A decade ago I was about to open an anti-rape training course for girls and women and as preparation had to intensely study the art of war and the most advanced ways to stop such an attack. I had to study and understand the most advanced shortcut moves used by the top special forces of the superpowers. These are moves that are either outlawed in any fight, or done with such quick and direct surprise that if there is a response on the part of the attacker-- it is an automatic knee-jerk response that they have no control over-- and yet which sets them up for your next equally controlling move:
If the moderator would permit an o/t final statement-- I'll offer what every father should teach his daughters to prevent rape, and save their lives. It can simply work with very little instruction/practice/training, and work every time on most any size attacker:
If attacker is surprise-struck below the heart-- they instinctively double over forward-- If an attacker is surprise-struck above-- they tend to bend backward and blink.
Q: The great equalizer is what?
A: The element of surprise.
Q: The best weapon ?
A: The brain/mind/instinct/conscience's ability to not be surprised and defeated so.
Q: the second best weapon ?
A: What is known as the equivalent of taking a bowling ball at 10+ mph to the nose of an assailant: The surprise headbutt to the nose by even a 12 year old girl can instantly break a man's nose-- and if done a few times in rapid succession, he will not be able to see and breathing will be impaired followed by a state of shock. The nose and eyes are no match for a bowling ball at 10 mph-- but it must be completely by a jerk-like surprise-- and repeated wildly till free.
No amount of any fancy martial arts training or kicks can really allow such instant and complete control over the situation to then be able to run free.
If you ever even 'see' a gun or knife in someone's hand-- do not get into freezing or complying, just do what animals instinctively do without fail every time when they sense danger of any kind-- they start putting distance away from the danger without delay-- and run like hell. If someone has a gun they will not shoot you because the sound would draw attention to them and statistics have shown that very few with guns can hit a moving target anyway. This is a reply to # 857,961i dont pretend to be an expert on this issue. however, mercola makes his entire living off of alt health care and alt health care products. he has a vested financial interest in keeping those products on the market. so i think his perspective should be considered.

This is a reply to # 857,964My personal opinion, for what it's worth, is that none of this makes any sense to me. Shutting down all the supplements and alternative medicine businesses would be $$$$$$$ lost in revenue, 1000s of jobs lost, etc. Would all those who have turned away from conventional medicine, go back to it, paying for office visits just to get supplements, therefore the $$$$$$$ lost being regained on the other side? I don't think so. This whole world operates by GREED and $$$$ are the only things that mean anything. How many multi-million dollars are involved in the alternative health care business? Is the government willing to give up that revenue, cause how many health food stores to fold, deal with the lose of how many jobs, etc? What would this do to the precious Dow Jones? Somehow I can't help but think this is a smoke screen covering up something far more sinister that we aren't able to see.

The UN is the first phase of the New Order - this may sound wacky, but is the truth. Dig deeper, read more.
Besides, your thinking is not complete on this -- if there is so much to be made in supplements, why WOULDN'T the powers that be wish to control this area as well?
You're getting a National ID card next year complete with an RFID chip in your driver's license. Next thing will be humans being chipped.....and then no one w/o a chip will be able to buy a pack of gum in the store.
It's all about control........especially control that the complacent, deceived and ignorant people have given over to their overlords.
Might as well just all admit that we are wards and we need our guardians. I cannot believe how people can be so duped!
Mark this day in time and then ten years from now, compare life as it will become.....things occur in stages.....gradually, but the AGENDA goes forward!

This is a reply to # 857,990I do believe that though Mercola is a doctor, he makes his money from contrarian doctoring, so to speak -- the majority of people who don't want to self-treat as we do here, but who do feel better taking alternative suggestions from someone with an MD. (I did not realize until I got to Curezone and started doing the things we do here just how big a step it is to investigate and research one's health concerns and to take steps toward amending them -- no wonder taking pills was always so easy! Not just because taking 5 pills 3 times a day is easier than doing a liver flush, for instance, but easier because someone else has assumed authority for the process and has predicted your results or explained them to you. It takes a certain, and not a small, amount of courage to take your health into your own hands!) At any rate, though, I think Mercola is protecting his investment on the supplement angle because he does suggest and sell many of them.
I also know that supplements are a huge business, and that they have a very powerful lobby in Washington. Certainly not as big as allopathic pharma, but it's a multi-billion-dollar-a-year industry, so I feel like "we" are being protected by that lobby -- it is simply not a case of the FDA vs. the little guy. The reason Orrin Hatch is mentioned in a previous post as someone to write to in the Senate is that Utah, which he represents, is home to a large amount of supplement makers, and also home base to pyramid-scheme companies that sell them (like Herbalife -- these are not supplements that probably a lot of people around here take, but they are enormously popular nationwide). Hatch's family members and former aides have gone to work for nutritional supplement associations and p.r. firms that represent them, which tells me that they are pretty big and powerful -- and that they are well-connected and have a lot of influence. The fact is, the supplements that we talk about on this forum are not representative of the vitamin and supplement market as a whole in terms of dollar amounts. I don't think they are going to go after Vitamin C -- I think they are going to go after weight-loss formulas. (The products of mine that concern me in terms of regulation are organ products, because of mad-cow disease and CJD -- which, to tell the truth, I think should be carefully regulated -- who at this point would want to buy something that might contain raw brain from a mad-cow country?)

This is a reply to # 858,247Let's just say that there is nothing to be alarmed about by this particular bill, then why are they working so hard to pass it. Why were they being so secretive about it. I just don't think it is as harmless as some would have us believe. When you consider the CODEX agenda on the international scene and the fact that this bill's supporters were trying to slip it by without giving us notice in time to comment on its passage, then I am VERY suspicious.
Perhaps its purpose may simply be to lay a foundation for future bills that WILL successfully remove our freedom to choose alternative health care and products. That is how it usually works, a constant chipping away of our freedom to choose.
It's a little like a game of chess. Perhaps this move or bill may seem non-threatening, but we have to look ahead at their possible future moves (bills) and block this move (bill) in order to block their ability to achieve a checkmate. At that point it will all be over and we will have lost.
Personally, my inner alarm system is clanging loud and long. If I err then I choose to err on the side of doing all I can to prevent this bill from passing. The only alternative is to feel secure, do nothing, and risk the loss of another freedom. History is replete with examples of people being lulled into a false sense of security.

And others have pointed to links referencing SB 1082 -- I have just read through the old act and the proposed replacement, and that is no real difference -- changes made are really nonsubstantive.

I guess I'm really confused why people won't weigh in and comment. I disagree with those who say it's not overreach, but why would anyone on curezone.com hesitate to weigh in on this and submit a comment in favor of natural remedies -- especially when we are talking FDA here. It puzzles me as to why anyone would refrain or pause to deliberate. Have we forgotten so quickly the fight that people went thru to get Essiac to the people, and also the Stevia battle.
On the one hand, I applaud reasonableness, but there's really no reason not to comment here. I think that people are splitting hairs to find a way to oppose this effort. It just seems odd to me!

Request to Extend Time Period for Comments
Reference is made to the Federal Register, February 27, 2007 (Volume 72, Number 38, Page 8756-8757), http://www.fda.gov/OHRMS/DOCKETS/98fr/E7-3259.htm, entitled: Draft Guidance for Industry on Complementary and Alternative Medicine Products and Their Regulation by the Food and Drug Administration.
In the filed comments NSF submitted to the FDA, the organization emphasized what we see as the important distinction between "treatment of disease" and its non-medical alternative, under AMA Ethics Code Opinion 3.04, "therapies that may benefit." The comments raised three demands:
1. That FDA hold public hearings before finalization of the draft guidance.
2. That FDA change the title of the guidance to use the phrase "Complementary and Alternative Modalities" and not the prejudicial "Complementary and Alternative Medicine" as in the draft.
3. That FDA recognize "therapies that may benefit" as not the same as "treatment of disease" and therefore not to be regulated as "medicine."
The organization also alerted its supporters, in keeping with its educational purposes. Many of theses individuals filed their own or supporting comments. As of the date of this request, over 108,822 have done so, by one count. This does not include about 267,063 people who tried to post comments but did not succeed, yet. Many of these remaining people may still want to submit comments, but may not be able to do so by April 30, 2007, a stated deadline for comments. While the Federal Register Notice states such a time limit for the filing of comments, there is other indication of a 90 day comment period, after the date of publication in the Register. This would extend to period until May 28, 2007.
Therefore, we are unsure of the effective end of comment period date, and as many more people want to comment, we must now request a clarification of the final date for the filing of comments and, if that date is April 30, 2007, Natural Solutions Foundation and the undersigned hereby request a 180 day extension of the period to comment, or such other extension as the Agency may consider reasonable. This issue is of such evident concern and importance to so many Americans that a substantial extension is required.
Kindly inform me by return email or facsimile of the Agency’s decision in this regard. The Foundation reserves all rights.

The FDA has been known to use legal maneuvering to try to end your access to natural health products (like vitamins, minerals and herbs) and natural health therapies of all sorts. We believe they are at it again. This time, their ploy is to issue a "Guidance" that implies these therapies can be "Medicine," which
creates the risk that any non-physician who uses them could be held to be practicing medicine without a license. Since these practices could be considered "Medicine" any products intended for such use could be considered untested drugs and could therefore be forbidden.
Your Comments are Vitally Important
Public, professional and industry comments are being accepted by the FDA on the proposal, that we view as a sly maneuver to "capture" alternative procedures and products as "medicine" and then make them illegal. I like his basic philosophies and appreciate that he reaches a LOT of people with his message (i.e., stay away from grains, YAY raw milk, vaccines are bad, flu is not to be completely feared, etc.) I am, however, glad to be part of the Curezone community, which is where I learn about what to do, per se -- I can't imagine Mercola ever suggesting OP, for instance. He's kind of ahead of the curve for most people, but I have a feeling that for many here, he is still pretty conventional -- it is all a matter of where you stand on the scale, for sure. A lot of people need those letters after his name to make it OK for them to do whatever it is they read about there and want to do -- and that's fine -- I have a huge appreciation for doctors who are willing to buck the trends in medical thinking and deal with facts. (Another "pop doc" that comes to mind is Christiane Northrup, whose books and shows have done a lot to help women be better mothers to their children, I am sure.)
I'll search on Mercola for basic research or information, but I'll usually check stuff out here in the archives or just asking on a forum. I do post on his new "Vital Votes" thingy from time to time and mention OP and liver flushing...although that thing is a pain to use, so it is a real labor of love for me to do it!

This is a reply to # 858,466thanks for your input :) What about his products?? Have or would you use them?? I'm trying to find good supplements but there are so many out there that I'm a bit overwhelmed ;( of course everyone thinks theirs are the best. As well as a Colon Cleanse and I'm sure my liver needs to be worked on as well.
ANy advice would be appreciated :)

I don't buy the Mercola supplements as I think they are pretty pricey -- lots look very attractive to me, but I am more likely to nose around here and see what others have tried and recommend. And I think that the standard protocols here are excellent for cleansing, and there is a lot of advice and support along the way. I am one who has tended to buy supplements but never use them, etc. -- so it was good for me to start here with some basic colon/ Liver Cleansing using cheap and easy ingredients. After I started oil pulling I did order oregano oil, but most of the oils I get are from local stores.
I am astounded when I read that the supplement industry is so enormous -- who the hell is taking all of this stuff, and why? My guess (somewhat cynical, after just driving through Virginia and stopping at a rest area where there were a lot of very big people eating a ton of sh*t from gas-station counters...) is that people buy stuff and have intentions of getting healthy but no resolve when it comes to following through...my opinion is that the basic ingredients most people need for cleansing are very accessible without expensive ordering, but the most important ingredient -- action -- is only found within -- i.e., I'm going to forgo the foot-long, start liver-flushing/fasting/etc. -- the motivation to act, rather than order another box of Herbalife, etc.!
Back to Mercola -- I'd love to try some of his clean meats, etc. -- and would if I could afford them -- but for now, I am doing as much as I can as cheap as I can. I spend money on the best foods I can afford, with an emphasis on high-quality fats and local produce. And let God take care of the rest....
