I would call the credit card company and tell them, why you have not made your payments. They are not monsters, they just wanted to get your attention. They have probably sent you many notices asking for payment and because you could not pay you ignored them or just did not call them.
Call them a once, and work out a deal they will work with you.

Just think about it, if YOU lent someone money, and they ignored your request for payment with no apparent reason what would you do, yes you would sue.

If it is to late, and they still threaten court, I would mention bankrupcy. There are three types of bankrupcy (I can't remember which one it is) in one you make a deal to pay your creditors over a 3 to 5 year time period.
