A common sense understanding will get you nowhere. The system has been built up, layer upon layer over the years, so that one the lawyer class and those with the funds to pay them can operate in the legal system. Not much of makes much sense logically anymore. If you go into a legal situation relying on common sense, you will find out quickly that the system operates on a different level.
