My wife is not a U.S. citizen, she has residency status (green card). She opened up a bank account before we got married (ssn not required) 14 years ago.

Today she received a letter from the bank with the envelope marked "important tax document enclosed". The letter basically is a Substitute Form W-9 Taxpayer Identification Number and Certification. It contains the usual color of law wording - "ABC Bank is required by federal regulation to have an assigned TIN on all deposit accounts. ...Your attention tho this matter is important. If we do not receive the properly completed form, we are required by federal regulation to maintain your name, address and account number on a list available for inspection by the Secretary of the Treasury."

I had received this kind of letter from the bank a number of years ago. Before 911 occurred, along with the Patriot Act, I went around the city looking for a bank that would allow me to open of an account without an ssn - specifically, a 'no interest' bearing checking account. And, yes, I was fortunate to find one with a vice president that knew of what the laws/regulations specified for banks. I was then allowed to open an account.

A few years after this, I also received one of these letters. It used similar verbiage. I felt it was important to rebut the banks presumption at the time so I wrote a letter back to the person who wrote to me, otherwise (as you well know), an un-rebutted presumption will be treated as factual. The letter I wrote to the bank is as follows:
