Yikes!

You poor dear!  It is good to hear that you are in such good shape other than the injury.  Now be very, very careful and let nature take it's course to heal you.  Good nutrition and proper rest and a good mental attitude are the best healers of all.  And I would say that giving nature a bit of a boost by making sure to get plenty of calcium, magnesium, vitamin D3, zinc, trace minerals, etc. would be a good idea too.  In general bromelain helps speed healing up to 4 times.  Dark green leafy veggies, such as organic baby spinach, are great sources of calcium and sunshine is the best source of vitamin D3.  The green veggies are also good sources of zinc as are meats, shellfish, wheat germ, hard cheeses, Swiss chard, lima beans, potatoes, and oats. Magnesium is found in abundance in whole grains, nuts, legumes, dark leafy vegetables, shellfish, figs, and lemons lemons. (Note all the good things dark green leafy veggies do!)

A good balanced organic diet, along with sunshine, is always the best source of vitamins, minerals and nutrients - however, given our nutrient depleted soils and the fact that your pimped out wheelchair may not be able to take you to a sunny locale every day for several minutes - you need at least 20 minutes or more of whole body sunshine every day to get enough vitamin D3 and I am not sure what your local ordinances may be regarding running around scantily clad in a pimped out wheelchair - if it were me, I would also add some supplements where your diet, climate, mobility, food supply and local morale standards regarding nude wheel chairing hinder adequate intakes of all the goodies you need.

One note: magnesium is best taken with a meal and recent research indicates that it might be best to take magnesium at a different time of the day than calcium and zinc if you are supplementing.

Hopefully you will be able to wheel in and catch the next proceeding, if ever there is one.  Right now, the judge took the issue of jurisdiction under advisement (meaning she did not want to make a ruling where anyone could glare at her).  The anticipation is that she really has no choice but to rule against Ben and so he has already filed a notice of interlocutary appeal.  From this point on, the issue of jurisdiction will be handled mainly via paperwork.

If a true constitutional ruling is made, Ben will win.  The bottom line is that the actual constitutional law only gives the federal government (and the State of Texas is using federal FDA code to claim jurisdiction) the right to regulate manufacturing and selling in the District of Columbia and any other US territory or possession, except the Panama Canal zone, that does NOT have a legislative body.  Since Texas does have such a body, there is no jurisdiction.

The government therefore finds themselves in a sticky place.  They have tried to use US Code, which is not actual law, but is formed from selected snippets of law, to force their authority on Ben and Utopia Silver.  Ben refused to accept such authority, and when you pull out the actual laws, there is no jurisdiction.  However, some important and knowledgeable observers who have followed the case are certain that the FDA had determined to make Utopia Silver and the sale of colloidal silver a test case to use for their ultimate restrictions against dietary supplements regardless of the law and ultimately pave the way for enforcement of the Codex restrictions.

Stay tuned!

Tony
