The Affordable Care Act, which critics have also called “Obamacare”, could subject smokers to premiums that are 50 percent higher than usual, starting next Jan 1. Health insurers will be allowed to charge smokers penalties that overweight Americans or those with other health conditions would not be subjected to. A 60-year-old smoker could pay penalties as high as $5,100, in addition to the premiums, the Associated Press reports. A 55-year-old smoker’s penalty could reach $4,250. The older a smoker is, the higher the penalty will be. Nearly one in every five U.S. adults smokes, with a higher number of low-income people addicted to the unhealthy habit. Even though smokers are more likely to develop heart disease, cancer and lung problems and would therefore require more health care, the penalties might devastate those who need help the most – including retirees, older Americans, and low-income individuals. “We don’t want to create barriers for people to get health care coverage,” California state Assemblyman Richard Pan told AP. “We want people who are smoking to get smoking cessation treatment.” Nearly 450,000 US residents die of smoking-related diseases each year, making the unhealthy habit a serious concern for lawmakers. One legislator is trying to criminalize smoking in his state, while others have raised taxes on cigarettes and the Obama administration has tried to inflict hefty fines upon smokers’ premiums. Karen Pollitz, a former consumer protection regular, told AP that no insurers want to provide coverage for Americans who have been smoking for decades, and that the penalties might prompt people to abandon the habit. “You would have the flexibility to discourage them,” she told AP. But quitting is not easy, and charging older smokers up to three times as much as younger ones could make it difficult for them to seek care in the first place. A 60-year-old smoker charged with the penalty could be paying about $8,411 per year for health insurance, which is about 24 percent of a $35,000 income and is considered “unaffordable” under federal law. “The effect of the smoking (penalty) allowed under the law would be that lower-income smokers could not afford health insurance,” said Richard Curtis, president of the Institute for Health Policy Solutions. Ultimately, the law that is meant to make health care more affordable could have the opposite effect on older smokers at a time when smoking-related illnesses usually arise. They are already penalized, paying close to $5.00 a pack.
How are they going to know who smokes? I could see that if you had a job, and the company was providing health insurance. My old job made us get tested for pot, on any day without notice.
They just made pot legal, and I recall reading that one pot smoke was equal to a pack of cigarettes in terms of the health aspects. Pot smoker will be the next to get penalized.
I can't agree that smoking is harmless, particulary since the makers started putting chemicals in them to make them addictive.
I don't agree with penalizing any group of people just for the revenue.
I don't agree with obamacare either, but if in fact there is a correlation between smoking, and disease I don't think non smokers should pay more for health insurance to cover smoking disease any more than paying more to cover for illegals who don't have insurance, or for people to abbort their children.
Ingested smoke is just one of many things ingested that when added to the other things like pesticides,GMO, flouride, chlorine, mercury, etc. over burden the body to create illness.

The human species is the only one that doesn't cull the herd naturally.
Meaning you either have to use logical sense in your decisions, or pay the price, so in relation to health if you consume junk food, or let yourself be exposed to harmful products so as to get ill you have nobody to blame but yourself. You are responsible for your own decisions, and life.
This applies to me as well. I ride my motor except on long trips without wearing a helmet. I'm aware of the health dangers, but still do it. Who's to blame If I crash and get injured? you?, the rest of the insured? One $100 would be enough incentive for me to ride with a helmet on.
If I was to be stopped for a ticket, they should charge me an extra $100 to be put into the health insurance if Obamacare survives. By the same token, if a person buys junk food, or drinks laden with aspertame products, and HFC's they should pay extra for the same reason. In addition the companies that sell this junk should be taxed for every sale. Those taxes would also go for obamacare.
If there is any fallacy it is for people who make healthy choices to pay for those that don't.
[Poor]-Are less likely to have a car to shop elsewhere if the corner bodega or convenience store stops stocking their vices.
I live about 14 blocks from a super market, and walk, or ride my bicycle most of the time to get something I need just to get some exercise and to save gas. You can always make excuses.
BTW, there are at least a half a dozen junk food restaurants along the way.
