The Struggle Over Our "Self-Evident Truths".
A comment in reply to "The Battle for Bacteria" article in Food Freedom.

The struggle is indeed over (the truth of) bacteria!
Feed your bacteria well and it'll do the same for you!

HR 2749 is another story!
The truth is that Congress was never given additional jurisdiction "to exercise exclusive Legislation" beyond it's Constitutional limits:
"... in all Cases whatsoever, over such District (not exceeding ten Miles square) as may, by Cession of particular States, and the acceptance of Congress, become the Seat of the Government of the United States, and to exercise like Authority over all Places purchased by the Consent of the Legislature of the State in which the Same shall be, for the Erection of Forts, Magazines, Arsenals, dock-Yards, and other needful Buildings".
That means "Acts of Congress" are only lawfully applicable in it's "District" and in the "Places purchased by the Consent of the Legislature of the State" etc.
The states can legislate well enough for themselves without the help of Congress. Besides, We have Inalienable Rights to our Life and that includes our Health, All our Nourishment and All Our Relations with the Animal and other Kingdoms of Life on the Earth!
What amounts to today as Governmental trespass into the sacredness of our food web/s and all those relationships was something that I don't think the founding fathers had imagined however, they reserved all the powers in the Tenth Amendment that were not delegated to the federal government:
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
"We hold these truths to be self-evident, that all ... are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness."
Our Rights to Life and health, etc. are self-evident Truths! All these Rights are Lawfully reserved! Since we already have the Right/s we don't need any "permission" in the form of any governmental authorization before, during or after we provide for our needs to nourish ourselves in all the ways we see fit. Any legislation against that spirit does not have legitimate authority to back it up. It may threaten with displays of force to coerce people under duress, etc. but that is not in standing with true American Law, that is only a show under "color of law".
We can make food a sacred part of our lives rather than allow industries (and the like) to completely turn it into a product for commerce which if shipped interstate can then come under federal regulations: "To regulate Commerce ... among the several States" But food in and of itself is not automatically a thing of commerce! This is another reason why "eating local" is so very important! Minimize the use of foods in commerce and you then minimize the need for the federal regulations on your food.
