Theory when used by scientist does not have the same meaning as when used in everyday speech.

A Theory is a an idea or group of ideas that have been confirmed through observation, and experimentation. The evolutionary facts fit into the Theory of Evolution.

Besides scientists are a cautions lot not prone to wild declaratiions, we have very few scientific "Laws". Unlike theologues, this means that our minds are open to change should new or conflicting evidence arise. None has.
