Couple plead guilty for bogus cancer cure

Husband, wife admitted selling “Energy Wave” from their former home in Carlsbad

CARLSBAD — A former Carlsbad couple has admitted selling an unapproved device they marketed over the Internet as a treatment for cancer and other medical conditions, the U.S. Attorney’s Office said.

David Perez, 60, pleaded guilty Tuesday in San Diego federal court to conspiracy. His wife, Sandra Perez, 55, pleaded guilty to sale of unapproved medical devices.

In their plea agreements, the couple admitted selling the “Energy Wave” from their former home in Carlsbad via the website myenergywave.com.

They have since moved to Medford, Ore.

They marketed the device as an effective treatment for cancer, AIDS and other conditions without getting approval from the U.S. Food and Drug Administration, a prosecutor said. The device had a “micro-current frequency generator” with a digital readout and stainless steel cylinders and application plates that were applied to the body, according to information presented in court.

David Perez admitted that as a way to defraud the FDA, he sent users to a separate website to get “codes” for settings for different diseases or ailments.

Each device sold for about $1,200 to $1,500, Perez said, estimating his gross proceeds at $271,000.

Sandra Perez admitted depositing the funds needed to pay a co-conspirator, David Arthur, who manufactured the devices, and also admitted that she shipped them to buyers.

David Perez is scheduled to be sentenced Jan. 11 before U.S. District Judge Roger T. Benitez. Sandra Perez was sentenced Tuesday by U.S. Magistrate William Gallo to one year probation. She also was ordered to perform 100 hours of community service.

“I believe you had to know at some level that this was junk science,” Gallo said Tuesday in court.

Arthur previously pleaded guilty to the Conspiracy and is awaiting sentencing.

The case was investigated by the U.S. Food and Drug Administration, Office of Criminal Investigations; Homeland Security Investigations; and the U.S. Postal Inspection Service.
