I actually spoke to an attorney regarding an identical matter. I was told that I absolutely had a case of medical neglect, failure to diagnose and/or mis-diagnosis.

Unfortunately it had been over a year, which is the statute in my state, so I waited too long.

Ironically, they can sue me 3 yrs later for medical bills, but I can't sue them past a year for their neglect.
