Who Owes copyright on the words published on CureZone?
The final copyright owner of any content (message / article / story / photo / audio / video) posted on CureZone is the AUTHOR!
As a webmaster, I can not give permission to re-publish any personal story published on CureZone, without being sure that the message Author agree to it being re-published in any format: book/magazine/e-book/e-zine/video/audio etc.
CureZone has the right to reproduce any content, but CureZone has no the right to give the content to someone else to reproduce it.
According to the CureZone
TOS (10. COPYRIGHT AND TRADEMARKS, Paragraph 2,3,4):
//www.curezone.org/terms.asp
"All Content is copyrighted as a collective work under the United States copyright laws and copyright laws of other countries, and we own a copyright in the selection, coordination, arrangement, and enhancement of such Content. You may not modify, remove, delete, augment, add to, publish, print, transmit, participate in the transfer or sale of, create derivative works from, or in any way exploit any of the Content, in whole or in part. All rights to such Content are reserved to their respective copyright owners. Permission is granted to electronically copy and to print in hard copy portions of CureZone for the sole purpose of education.
Except as provided in the preceding sentence or as permitted by the fair use privilege under the United States copyright laws (see e.g. 17 U.S.C. Section 107), you may not upload, post, reproduce, or distribute in any way Content protected by copyright, or other proprietary right, without obtaining permission of the owner of the copyright or other proprietary right. Any other use of the Content on CureZone, including reproduction for purposes other than as noted above, modification, distribution, replication, commercial or other use, without our prior written permission, is prohibited by international laws.
For every single message, digital image, article, answer or ad that you post or upload on
CureZone Forums ,
CureZone Blogs , CureZone FAQ's, CureZone Directory, CureZone
Image Gallery , CureZone Quotes, CureZone Articles etc... you agree to grant proprietary rights to Curezone.com.
By submitting your own message or a digital image on
CureZone Forums ,
CureZone Blogs , Curezone FAQs, Curezone Articles etc, you are agreeing and giving proprietary rights to CureZone.com, including rights to reproduce, modify, distribute, store, augment, publish, replicate, transmit or delete your article, message, digital image, answer or ad."
In reality, if you post a message on CureZone, you owe copyright, but CureZone still has a legal right (given to CureZone by you, the author) to reproduce your message inside CureZone Newsletter, or even to reproduce your message inside an e-book (not that we are ever going to publish CureZone e-book or even a printed book, but if ever, in the future, a "CureZone" book is published, CureZone has a legal right to re-publish individual stories / images previously published in
CureZone Forums /blogs/image galleries/ etc.)
Aside all legal mambo jumbo, if CureZone would ever publish an e-book or paper book, I would make sure that if any personal story is included into that book, owner of that story would be contacted, and would give written permission for re-publishing of his/her story inside a paper book, especially if the book will be sold for profit (most paper books are sold for profit, as it is very expensive to print them and distribute them).
If anyone else, other then CureZone would like to use any text or image or video/audio previously published on CureZone, the legal way to do it would be:
Obtain a written permission from the message Author.
Obtain a written permission from CureZone webmaster.
I as webmaster, would always give a permission, if the original message Author would agree for republishing of the original story, but I would, in addition, ask that reference is included with the story. ( reference = URL to the original CureZone web page where the original message was first time published ).
As a webmaster, I can not give permission to re-publish any personal story published on CureZone, without being sure that the message Author agree to it being re-published in any format: book/magazine/e-book/e-zine/video/audio etc.
