Since I have been researching the issue of tort reform/doctor discipline, I understand now that there is a white wall of silence. In fact the AMA (and NC Bd of Medicine) considers the doc "practicing medicine" when they testify for their patients. So many hospitals (esp in NC) have a Code of Conduct that allows docs to testify in court for doctors but not patient - not even their own patients! The treating doc is scared of getting disciplined by the AMA. So the treating doc does not want to get involved. It is no surprise that med mal attys don't take cases - they can't find experts!. Who the heck protects the patients???
