Hey all, I just wanted to give you the update. I do think justice has been served.
Its a little to late for me because I was raped when I was in middle school, and now I am middle aged, but it seems as though my rapist has gotten his just desserts.
He was convicted of domestic violence, and another rape about 12 years ago. But the real kicker came when an agent targeted him and sold him child porn.
Due to the violent content of the images, and the amount, PLUS his priors, the sentencing guidelines dictate a mandatory 10 year prison sentence. Additionally, the probate committee wants to increase his violent status in the system. Not only that, but due to the conviction, he may lose his rights to even be in the country!
The defense attorny is trying to suggest that he engaged in this disgusting noxious behavior because of a medical condition 4 years prior to him doing the act, and she is blaming his sick mind on Depression and this medical condition that caused this perversion. Additionally, she is trying to negate the prior convictions, and is disagreeing with "sexual predator upgrade".
I am not an attorney, but her claims seem baseless to me. Although he is having medical problems due to his alcohol abuse, (transplanted kidney) and the defense is claiming that the if sent to jail, he will die.
Well, that was the sentencing memorandum. the prosecution has time to decide how to respond.
In these cases 50% of the times, the judges deviate from the sentencing guidelines, but my rapist is actually a real rapist. He is not just some guy downloading porn.
He went out of his way to meet the agent/mail man, to have these sick videos of the prepubescent girls and boys delivered to him.
I guess these laws are so strict for a reason. Its hard to prove rape, but its easy to prove images downloaded on a computer.

This is a reply to # 2,021,583Ok, another update.. Rapist had judgment against him, and he filed for appeal. It had something to do with him agreeing to a plea bargain on two counts, and not understanding that the result would be deportation. Because of the variations in prison sentences when it comes to child porn, he thought he could get his sentence reduced from 10 years to five.
I read the court transcripts, and over and over again, the judge warned that he was giving up his right to a trial, and even the ability to appeal!! ( I didnt even know that it was possibly to take someone's right to appeal). They said that the plea would stick, even after the probabtion report came out, (apparently there was another one, and this one was sealed, dont know what is in it). The judge warned that if the probation report didnt support a lessen sentence, he couldnt take back the plea, pleading guilty on two counts.
The probation report came back that he was a really violent sex offender. Instead of getting 10 years in prison, it was upped. Additionally, they solidified that he would he would be deported, and if he tried to come back to the country illegally, he would be jailed for life. Additionally, he was ordered to pay restitution of $500K. The judge gave absolutely no merit to the defense attorney's arguments, but he did say she was a good lawyer.
So in the end, defendant/rapist, ended up a lot worse off because he tried to defend his actions. He was wanting a jail term of five years, with hopes of getting out in 1. Instead they increased his sentence, and made the supervisory period for life.
Not only that, but the supervisory period is horrofically intrusive, (rightfully so). Anyone he associates with has succumb to the intrusive nature of privacy invasions, just for being in his presence.
In short, they took away his right to appeal, and increased his sentence. I cant go into all the details of his sentence. It was like three pages of all this extra stuff, (ie, he is not allowed to have a computer because this goes against treatment, etc. .. He cant eve surf adult porn, etc. ).
Finally... This scumbag has been raping school aged girls for so long, about 20 years... and giving them diseases. He finally got his just desserts.
The court record put him on suicide watch, since people with this sentence, (per the transcript) have a tendency to commit suicide.
