WHO CRAFTED PROP 37?
WAS IT WRITTEN BY ONE LAWYER AS THE NO SIDE PROPAGATES?
Who were the team what really wrote Prop 37? Dr. Bronner, President of Dr. Bronners Magic Soap was instrumental in getting Joe Sandler, Washington D.C. esteemed lawyer who advocates for putting Lobbiyists in their place. Joe is the Dr. Bronners attorney. Dr. Bronners is among the most ethical model companies in the US promoting Fair Trade and "Coexist" among all peoples. Many were consulted in crafting this simple brilliantly written Proposition that was simple enough to win. Others involved in the writing were Andrew Kimbrell, of the Center for Food Safety; John Fagan, a Scientists who specializes in Identifying GMOs in Foods. A host of farmers, grocers, and legislative specialists were called in. James Wheaton, attributed with writing the bill by the No on 37 Campaign, is an environmental lawyer who teaches at Stanford and is an advocate of First Amendment Rights. He was hired in the final weeks of the campaign as the main "Proponent," the person who submits the proposition to the State Attorney. He came in in the final weeks and had little to do with the actually crafting of the proposed law. Wheaton helped craft Prop 65. Prop 37 is very unlike Prop 65. The Legislature can refine the law after it passes if need be. Prop 37 was specifically crafted to cause no harm, no red tape to farmers. Pamm Larry, head instigator, told me it will cost about 350,000 at most to admin Prop 37, about one cent per person. It is a specifically a People's Initiative and the state will have little do do with its enforcement. Enforcement is left to people with stipulations that they themselves can be fined if they unjustly accuse a manufacture of misbranding. THe law gives ample time for all manufacturers to add a simple label, and where similar labels were accepted in Europe, food costs did not go up. This is law that gives us all the Right to Know and reestablishes the the Foundational Principles of America The Beautiful and Food Democracy in America.--

Prop 37 Lawyer Claims He Never Thought Much About His Wording

Here is a head scratcher; when confronted about the vague, conflicting language in Proposition 37 - even the real name, the California Right to Know Genetically Modified Food Act, is weird and disjointed - Attorney James Wheaton, who made his fortune in nuisance lawsuits under the Proposition 65 labeling act he championed, told the Sacramento Bee's Dan Moran he put so little thought into the verbage of Proposition 37 that he he hadn't given any thought to whether he might litigate over the new measure, if it passes.
Wait, a lawyer who was hand-picked by organic food companies TO WRITE AND LEAD THIS INITIATVE doesn't think he will sue, despite that being all he does, or even think it will lead to lawsuits? Consider me skeptical.
NOPE...STOP...HALT...WAIT HE WAS NOT THE WRITER.
HE WAS THE LAWYER WHO TURNED IN THE WORK AT THE END BECAUSE
HE KNOWS HOW TO TURN IN LEGISLATION
Wheaton had very little to do with the writing, or the crafting...he was the one chose, to turn it in.
In retrospect, from the PR that the 41 Million campaign made of this, Wheaton was a poor choice, but who knew? He is also a teacher at Stanford and has been involved in many good causes. Prop 65 has backfired in the eyes of many causing litigation and issues. Prop 37 is very differently written. For one thing, the legislature, if it chooses, could refine the bill. it was carefully worded to avoid issues such as litigation.
Further, the bill has no relationship to hurting farmers and little effect on
red tape.
Farmers are out of the picture. Organic farmers are exempt. Others just need to say on an honor system that they have a receipt for their seeds. There is no oversight from the state on this. There is no beauocratic set up, despite all the false No on 37 claims.

Andrew Kimbrell is a public interest attorney, activist and author. He has been involved in public interest legal activity in numerous areas of technology, human health and the environment. After working for eight years as the Policy Director at the Foundation for Economic Trends, Kimbrell established the International Center for Technology Assessment (CTA) in 1994 and the Center for Food Safety(CFS) in 1997. Kimbrell has written several books and given numerous public lectures on a variety of issues. He has been featured on radio and television programs across the country, including The Today Show, the CBS Morning Show, Crossfire, Headlines on Trial, and Good Morning America. He has lectured at dozens of universities throughout the country and has testified before congressional and regulatory hearings. The concerns about prop 37 adding to government jobs and need to oversight are not accurate.
