"Last week, President Obama told German media that Edward Snowden "raised some legitimate concerns" but that he couldn't pardon him without the whistleblower first coming home to appear before a court.
That's not quite right. Our Constitution gives the president the power to pardon anyone he wants, even in the total absence of legal proceedings. Take Richard Nixon, who Gerald Ford pardoned before any charges were filed.
Also, the president surely knows Snowden wouldn't actually be able to make his case to a jury. Any argument relating to his motivations or the benefits of his disclosures would be inadmissible under the charges he faces. ..."[2]
