Letter of response to the Health Inspector in Prince George who was advising a Canadian cow share not to "sell" raw milk.

I am disappointed that you did not respond to the two voice-mail messages I left you back in February about the legality of cowsharing. It would have been better had you spoken with me then, so as not to be still labouring under the mistakes apparent in your letter to Lesley McConnachie of March 25 2009. In fact, she nor Hunny-Do Ranch sell raw milk.
Your letter to Mrs McConnachie says you did view the website of the Campaign for REAL MILK http://www.realmilk.com.
Therefore you cannot plead ignorance of the fact that raw milk is available, quite legally, in the majority of the united States of America. You now know that the proposition that ‘all raw milk is always and only a vector for human pathogens’ is incorrect. You must admit that raw milk can be produced safely. Home on the Range has been doing so for nearly two years in BC.
In order to carry out your duties as a Health Inspector you are obliged to fully-inform yourself on this topic before interfering with the property of private citizens. Until and unless you do your due diligence about the benefits to those who consume it, of pure whole fresh raw milk, versus risks of illness, you are in ignorance. In October 2007 Mark McAfee gave us a 70-minute seminar about his operation, Organic Pastures, the foremost raw milk dairy in the world. He presents this seminar to audiences all over America, including to medical students at Stanford University. His business sells $6 million of raw milk and dairy products per year throughout California. I sent the deputy Minister of Health a copy of that seminar in DVD format. Thus Northern Health - and you in particular - are responsible for knowing that information.
You cannot say you don’t know that ‘cowsharing’ is lawful. By which term I mean the arrangement whereby individuals co-operate in underwriting a dairy so as to get food for our own sustenance. ‘Agistment’ - whereby one contracts with a farmer to look after his animals - is an ancient practice well known in British jurisprudence. Cowsharing is merely us, as a syndicate, asserting our right to use and enjoy our private property via agistment. It is one of the common law traditions included in section 26 of the Canadian Charter of Rights and Freedoms which protects us against bureaucratic meddling.
Enclosed find copies of the letter from (then) Minister of Agriculture John van Dongen; also, the letter from (then) Acting Director of the Health Protection Branch Ron Duffel. They make clear to anyone with a junior high school level of literacy that what we are doing is exempt from the laws upon which you pretend to rely for authority. If you, or your legal counsel quibble what is meant by the term “direct care” of animals which are the subject of my contract with Lesley McConnachie for agistment services, then I demand you produce statute law/case law on that precise point: I have yet to see any.
Via FoI demands upon Health Protection Authorities after they issued Cease + Desist Orders to do with our raw milk here in the Lower Mainland, I obtained emails showing that officials knew there must be a complaint as the triggering event for them to act. Yet to this day, they refuse to divulge the name / contact information of that - purported - complainant. I believe there never was any real complaint. Rather; the Fraser Health Authority and the Vancouver Health Authority wittingly acted outside the mandate of their authority. Worse; that they did so with intent to defame our raw milk dairy in furtherance of a conspiracy to restrain trade, rather than from genuine concern for the Public Health.
In law, such misconduct is known as “malfeasance of public office”. In such a case, the statutory protection against being sued in a civil lawsuit does not avail for a Health Inspector. If you mis-use the powers and resources of your office to interfere with property rights of people who hold shares in the Hunny-Do Ranch cowshare, by acting outside the scope of your mandate under the Health Act and especially with knowledge that what we are doing is legitimate you will open yourself to a lawsuit for the tort of malfeasance of public office.
Inasmuch as an Order under the Health Act is equivalent to an Order of the Supreme Court of British Columbia, then an Inspector who utters an Order ostensibly according to that Act, knowing that it is without proper foundation, commits fraud upon the Court. You are hereby notified that an Inspector who does so can be compelled to show cause why he or she ought not to be found in contempt of Court.
When people agree one with another to do a thing which they know - or ought to know - is illegal, that’s called a conspiracy to commit an indictable offence. For which a private Information may be laid before a judge. You are hereby advised that I am one of British Columbia’s lay experts in the laying of private Informations and have been acknowledged by Her Majesty’s Judges as a private Prosecutor.
Pursuant to the Freedom of Information & Protection of Privacy Act RSBC, I hereby demand copies of all records of every kind, in any and every format, maintained within the entire Ministry of Health, particularly your office

You are hereby notified that in the three instances where Fraser Health Authority and the Vancouver Coastal Health Authority issued Cease + Desist Orders on people / businesses which were storing raw milk for shareholders of our raw milk dairy, I appealed them. Those appeals are pending, awaiting transcripts of evidence given by expert witnesses at the trial of Michael Schmidt in Ontario, on charges of ‘selling raw milk’. You are hereby notified that Michael Schmidt brought on a Constitutional Question as to the validity of the provincial legislation under which he was charged. In light of the above, you have a duty to inform yourself of the rationale for my appeals. Lawyers Neena Sharma and Guy McDannold have all that material.
NOTE BENE that section 56 of the Health Act gives you power to inspect foods and substances which are offered for sale, or are in preparation for being offered for sale,
but since the milk from our cowshare at Hunny-Do Ranch is not offered for sale, a Provincial Health Officer has no jurisdiction over it in the first instance.
I have arranged with Lesley McConnachie to purchase a share in the herd of dairy cows for which she is the Agister. If you or anyone from Northern Health slaps a Cease + Desist Order on Lesley McConnachie and/or Hunny-Do Ranch, be assured that I will appeal it in the Supreme Court of British Columbia at New Westminster
