Saturday morning update: Asked about the status of the food safety bill during a morning press conference covered by C-Span, Sen. Dick Durbin (D-IL) said: "The good news is it is not dead, the conversation is still alive on the floor of the Senate today."
Durbin said he is hopeful the measure can be included in "the wrap up" of the lame duck session.
Someone asked if he knew a Republican co-sponsor was saying it was dead, and Durbin replied: "I would have said the same thing an hour ago."

I am writing to you as your constituent and as a member of Citizens for Health, the voice of the natural health consumer.
I understand that the House passed H.R. 3082, the Continuing Resolution that provides government funding for the next fiscal year. I also know you will be considering the resulting Omnibus Bill any time now, with an amendment from Senator Inouye including the objectionable language from S. 510. This is both bad legislative practice and horrific public policy.
Whether it is a stand-alone bill, part of another "must pass" bill, or offered with a new name and number, S. 510 gives control of food to those responsible for virtually every significant food-borne illness outbreak and for the generally poor quality of our food supply: The Agribusiness Industry and large-scale factory farms.
Our food is dangerous because of chemical and bacteriological contamination and, even when not contaminated, is produced by techniques inconsistent with prevailing wisdom regarding healthy foods.
Now that the House has attempted to bury this bill in a Continuing Resolution, a "Must Pass" Bill, it is vitally important for Senate leaders to protect both the people of the United States and the legislative integrity of the US Congress. I urge you in the strongest terms to lead the effort to stop S.510, or any permutation thereof.
Family farmers, ranchers, gardeners, health and food freedom advocates, and monitors of governmental integrity have sent more than six million emails to you and your colleagues to oppose this bad bill.
Let the new Congress consider ways and means to protect our local, natural food production and distribution from FDA interference. I urge you to vote "NO" on the amendment which replaces S. 510.
I will remember your vote.
Naturally, I support efforts to ensure the safety of what we eat and drink; however S. 510 would ultimately make our food less safe, not more. In addition, the bill would do so at the expense of health food retailers, manufacturers, and consumers of natural foods.

The House has sent the food safety bill back to the Senate piggybacked on a catchall spending bill. The combined legislation passed tonight 212-206.
The Senate already passed the food safety bill 73-25 but the measure’s future was thrown into doubt because the bill included revenue provisions that should have been first approved by the House. Fixing the bill was no problem, but House leaders didn’t want to send the legislation by itself back to the Senate for fear that it could be blocked by Republicans who don’t like it. So the measure was attached to the must-pass spending measure. Now, the Senate needs to act on the combined bill. The Senate , has been working on its own version of the appropriations measure.
The food safety bill would give the Food and Drug Administration new powers to regulate food processors and produce farms and increase standards and oversight of imported foods. An exemption that the Senate put in the bill for small farms and processors drew opposition in the House but it didn’t turn out to be enough to block the legislation.

It's a waste of taxpayer money,
and the stated goals won't be achieved.
In its rush to enact sweeping new food safety legislation during the lame-duck session, Congress hit a procedural roadblock that may put the bill off for at least another year. User fees added to the Senate version run afoul of a constitutional requirement that tax measures originate in the House. That's good news for consumers because this expansion of Food and Drug Administration regulatory authority would waste billions of taxpayer dollars without making our food supply any safer.

The food industry plays regulatory roulette
After championing a bill to heighten federal regulations and empower the Food and Drug Administration, some of the food industry's giants found themselves last week trying to kill the measure.
The lobby for large food retailers and processors spent two years championing the big-government Food Safety Enhancement Act, while small farmers and processors said the bill's "one-size-fits-all" regulatory requirements would kill Mom & Pop, helping the big guys.

Our Next Step is to Continue Inundating the Senate -
1. We agree with Ron Paul (with whom we visited today, that [S510] is very bad legislative practice to combine a controversial regulatory bill with the Continuing Resolution needed to fund government activities. This bill will impact dietary supplements. That is clear from the way the FDA used section 301(11) of the 2007 FDA "enabling act" to outlaw a form of Vitamin B-6, although Congress put a clause in that bill "exempting" DSHEA products.
FDA will use any new food authority to attack supplements and natural remedies.
2. It is unprincipled to push this bill against the clear will of the voters that the Federal govt is too big and must stop over-regulating.
3. A clean Continuing Resolution is needed so that Congress can decide to continue funding at a certain level without muddying the process with extraneous matters.
4. The vote was nearly a pure partisan vote, with no Republicans in favor of this maneuver, and only a few Democrats standing against the lame-duck "leadership." We will remember!
5. The People will keep a close eye on all GOP Senators and expect them to act from principle and not add this budget-busting bill, with its 4,000 new FDA agents to harass local food production and distribution.
For those of you who didn't follow the events on Twitter or C-Span, the House lame-duck "leadership" pushed the "Food Safety" Bill, formerly known as S.510 into the "Continuing Resolution" Funding Bill to keep the Federal Govt running for another year, pass this Hot Potato to Senate again. That body could act Thursday, December 9th.
The House vote appears to have been 212 to 205, with no Republicans voting for the bill. The next step is to continue inundating the Senate with voter outrage.

FOOD SAFETY LEGISLATIVE SAUSAGE-MAKING CUTS OFF OPPOSITION

Throughout today, the NHF continued to lobby against, and closely follow the trail of, S.510 as it made its way through the House, with S.510 being thrown into the 2011 Continuing Resolution (CR) as an amendment. The CR was approved by a vote of 212 For and 206 Against, with 8 Republicans not getting to vote.
The 2011 Continuing Resolution funds all of the Federal government for the next year and is a “must pass” bill to keep the government open past next week. Realistically, it would be better if the Federal bureaucracy were shut down as less harm would be done to the economy and our lives. Republicans wanted a shorter-term CR, but were not even allowed to have a vote on doing this. So much for the “Democratic” process.
Make no mistake, Speaker Pelosi and her Democratic lieutenants used all of the legislative tools at their disposal to short-circuit the normal legislative process so as to pass the misnamed Food Safety bill. Prior to debate under a closed rule, the rule to approve S.510 as an amendment and hold a final vote was adopted by a vote of 207 For and 206 Against, with Pelosi herself casting the deciding vote. The Democrats held the vote open just until they could get their one-vote victory, and then immediately gaveled the vote closed with ten Republicans not being able to vote! And who was it who said that party was misnamed? Who reading this can ever think the Democratic leadership represents democracy?
Statements of opposition included reference to the inclusion of the Tester-Hagan exemption-for-small-farmers amendment in the Senate bill as a reason for not supporting S.510 and passage of the temporary spending bill. In typical legislative sausage-making, the CR includes S.510 and several other bills to fund Pell Grants, the airport trust fund, and new money for more airport full-body scanners to name a few. This amendment strategy was done because there was not enough support separately to pass them as freestanding bills.
In our last News Release we had asked the question as to whether S.510 was dead or not. It continues to live due to the legislative shenanigans of Speaker Pelosi and Company. As we said then and will say once again – NHF members and supporters are strongly encouraged to act now to defeat this bill. Now that the action switches back to the Senate, call or send emails to your Senators asking that they vote against passage of the Continuing Resolution that contains this S.510 monstrosity. Keep in mind that there is still time to have a joint House/Senate conference on S.510.

Democrats attempt to revive food safety bill

WASHINGTON (AP) - The House has passed sweeping legislation that aims to make food safer in the wake of E. coli and salmonella outbreaks in peanuts, eggs and produce.
The bill would give the government broad new powers to increase inspections of food processing facilities and force companies to recall tainted food. The House is sending the bill to the Senate as part of a giant year-end budget bill.
The Senate overwhelmingly passed the bill last week, but it stalled after House Democrats said it contained fees that are considered tax provisions. Under the Constitution, such legislation should have originated in the House.
By sending the food safety bill back to the Senate tucked into the larger spending bill that must be passed by the end of the year, Democrats are hoping to circumvent Republican objections that delayed passage for months in the Senate. The budget bill narrowly passed the House 212-206 Wednesday.

Both offices tell us that the only thing that will prevent this bill from final passage is massive public outcry... we must continue to Push Back!
The one thing that is clear is that there seems to be no clear path out of the Food Safety Woods created by the Senate. Some argue that the Senate needs to re-vote (with Senator Coburn then in the way) and then send it to the House for a vote or a Conference. Some argue that the House can simply vote on the Senate version. However, given that the House has sent the Senate a few hundred Bills in the last few years that have been largely ignored, I am not too sure that the House will be all that interested in helping out the Senate. Some argue that the House will insert S. 510 (or a version of it) in a House revenue Bill and send that back to the Senate to vote on (with Senator Coburn then still in the way). Confused? Me too.

REPUBLICANS COMMIT TO
FILIBUSTER
Entire Senate Republican Caucus Commits
To Filibustering Anything Prior To Budget, Tax Cuts
The surprisingly easy passage of the Food Safety Bill --
hailed as a hopeful sign of bipartisanship --
made the GOP leadership all the more determined
to take control of the timetable.
I agree with Bill Marler, the food poison attorney,
that we need a Food Safety bill that helps the innocent
be free of possible food contamination.
#S-510, through the rush to get something
into law, is bringing notice of this
highly controversial bill into the view of more and more people
A national conversation is beginning
to Chew on Food Safety.
We arein a National Food Emergency as much as
a Food Safety emergency.
This bill is controversial. It deserves careful attention
and to be brought before the American people rather than attempted to be
slipped into law.
Too many elephants in the tent here:
The FDA is unworthy of more regulatory
power. Their lack of funds has not stopped
them for going for a knock out punch
on the Artisan cheese makers and whoever else they deem
a problem.
OUR FOOD CZAR IS CALLING THE SHOTS ON THIS
AND HE NEEDS TO BE VETTED FULLY
Until we fully look at who is calling the shots on Food Safety,
including Michael R Taylor, the former master of the revolving
door, we cannot pass honorable legislation.
Mr. Taylor is the "national hero" who brought us the go ahead for
GMO foods, and hormone additives in milk. He is a major
player in paving the way for international Food Rules-Codex-
that are not good for natural supplements, food as medicine,
and the the welfare of small farmers.
#S510 BRINGS TO THE TABLE REAL ISSUES
THAT NEED TO BE RESOLVED
WE, AS A NATION,
ARE IN THE DARK ABOUT FOOD CHOICES
and KNOWING HOW TO EAT TO BE HEALTHY
Most people do not know how to eat,
what is good for us, or how to be healthy.
Most of us are on minimum life support

life together. Health Reform can only happen
