PRESS RELEASE ISSUED
THANKSGIVING DAY 2009
in BEHALF OF THOUSANDS
of ENDANGERED RARE FRUIT TREES

Written by Leslie Goldman
AKA Your Enchanted Gardener
on the PLANT YOUR DREAM BLOG

Step forward now. Please purchase a rare fruit tree
Thousands of rare fruit trees new homes.
This is a request issued by the new Facebook
cause Friends of Exotica Rare Fruit Nursery.

Want to commit to a bright green future for
our earth? Now is the moment to join this cause,
buy trees, and buy trees for others to adopt.

Thousands of the rarest of fruit trees, representing a
priceless collection of genetic biodiversity
face impending "eviction" December 1.
Breathing room--giving Friends of Exotica Rare Fruit Nursery--
a FACEBOOK cause--more time to set in place
a business and donor model will be made possible
as the global and local community steps forward now
to pay bills that include a $2600.00 rent need
for the three acre parcel in question. Additional money
is needed each month to pay rent on two other adjoining
acres, salaries for employees, and other bills that include
water costs.

Spangler has not paid rent on the three-acre parcel
since June of 2008. The present owner, an "Angel" who
stepped forward to rescue Spangler in 2002, when
the land was also jeopardized, is ill with cancer.
A trust, represented by his power of attorney
was with him in court, as was the plantiff's attorney
JAMES. W. BURMEISTER of Carlsbad, CA.

Making the rent on December 1,
will allow time come up with a long range plan
to pay back rents, pay bills, as well set in place
a purchase plan. Others, including
Anthony Russo of the Biosmart company
want to step forward to create a web presence
for Spangler. The ball is in Spangler's hands
to commit to a business model that can
resurrect the nursery and root a sound
financial future.

According to an agreement
made in court November 19, Spangler must
pay the rent of $2600.00 for the months between
now and August 1. August 1, he must pay
an additional $130,000 in back rents. He has
an option to buy the three acreas for $350,000
at any time during this period. If he fails to make
payments, the attorney for the plaintiff will call
the sheriff and an immediate lockout-- an eviction
notice--will be issued.

In that case, the trees in the ground will be the property
of the current owner, Paul Pancritius. The trees in the
ground represent twenty years of work on the part of
Spangler, who in years past traveled to distant
parts of the world to gather a treasured collection
that will be of value to universities and agricultural
institutions. Spangler has collected many kinds
of diverse species of pomegranates, and other
tropicals. He also has natives, such as the drought
tolerant Jajoba Tree, and many healing plants from
around the world. Numbers of the plants are suitable
to be sold and mailed as seedlings. Spargler is a bounty
of earth wisdom and can consult with others as to how
to plant and care for the trees.

He commonly shows us with a bounty of beyond
organic--biodynamic fruits at various functions.
The many "Virgin" rare fruit eaters he meets
are stunned to be introduced to the fruits
that are for the most part not sold in commercial
stores.

The value has been placed at 1.3 million.
If Spangler defaults on the rent. He has no other
legal options. In court, November 19, Spangler came within
threatened agreements through his
attempts to place statements in the record that he was
signing the agreements under duress. That statement
would have at a future date given him the option to
back out of his agreements. The plantiff's attorney
objected. The final agreement was then made before
the judge.

The stressful and loud court proceedings
left both the plantiff's attorney and the plaintiff
in high levels of stress, as was Spangler.
The commissioner hearing the case Donald Armento
was a fair and compassionate judge. Burmeister
showed sincere concern for his client who was
thrown into extreme mental stress by the proceedings.

Making the rent payment of $2600.00 to
attorney Burmeister on December 1,
will ensure that the nursery remain open
until January 1, giving the community time to regroup
and make long range plans and/or a business model
to turn the in-the-red Exotica Nursery
into a sustainable business.

The loss of the three acres of the nursery
can be averted if caring people who want to make an investment in our
shared future,
