I have heard this statement from time to time but I have not ever seen any post that specified any law to support such claims.

While it is not specifically approved by the FDA, I have read there are some devices taht have been approved by the FDA that use the principal and there have been a number of patents issued.

This technology can also be used under an IDE permit from the FDA which allows devices to be used for investigational and research purposes.
