Tough road there... This type of claim is typically barred under the legal doctrine of sovereign immunity:

As if that should surprise anyone around here. Anyway, in short, there are laws that permit certain types of lawsuits against the government (civil rights violations for example), but claims against the FDA for negligence... I don't think so. The court system is pretty much a black hole anyway... Best avoided unless you really know what you are getting into.
