All that was needed to be done to render the constitution obsolete was to destroy the moral / religious character of 51% of the population, since in a Demonocracy, the majority rules. This became possible with the advent of mass media, which is generally controlled by people having a different set of morals than those who fought a Revolutionary War and installed the constitution.

Of course the National government in DC was never given any legislative jurisdiction over areas in the several states of the Union, but can only legislate for "territories and possessions of the United States", which DC, Guam, Puerto Rico are. So when a law is signed by El Presidente that specifies that it's illegal to walk down the street with an Exacto knife in your vest pocket, it does not apply within the several states of the union, unless the State legislature had specifically ceded legislative jurisdiction to the United States in that area.

The United States government has no legislative jurisdiction in the several states of the union unless the State legislature(s) have specifically ceded legislative jurisdiction to the United States. That's the way it is set up, and Eisenhower's admin did a lengthy study on this and issued a report in the mid 1950's. Actually, it was the commies in the State department who wanted it, so that they could evaluate what they were up against in making the changes they wanted. Just internet search "eisenhower legislative jurisdiction" if you want to find more.

The United States is a weak government. It has essentially no legislative jurisdiction. The Cleveland Ohio City Council can pass a law which puts people in jail for not mowing their lawns, but such a law would not apply in Des Moines, Iowa, because Cleveland city council has no legislative jurisdiction over Des Moines.

If the people out there had any brains or desire to maintain their liberties, they'd have read about this stuff and challenged the legislative jurisdiction of the US in each case where it was overextended. One is free to volunteer into a system and by not raising objections to jurisdiction early on, one essentially waives the right to do so later. If the people held the National gov in DC to the bounds put in there by the framers, there'd be less of a mess.

All that stuff like Patriot Act, martial law powers, executive orders, etc., only apply to the territories and possessions of the United States, unless the several States of the Union specifically cede legislative jurisdiction to the National government. Or unless one volunteers into it. That's the final answer.

But, people being the ignorant fools they are, what good is the law, if none of them believe it, but rather have been trained into believing that they are living in a military dictatorship, and ignore bona fide assertions of others relative to proper application of the law ? That's where we are today. Owing to their lack of moral character induced by mass media, more than 51% of them are unfit to partake in the benefits of liberty, and have only come to know how to live in what now resembles a Dictatorship more than anything else. It's not that the people in GOV are doing this. It's the public who are doing it. They feel powerless, when in reality exactly the opposite is true. All political power derives from the People. They're just too stupid to know it.
