FDA's Views on Freedom of Choice

Here are some of FDA's views expressed in its response on 'freedom of food choice' in general and on the right to obtain and consume raw milk in particular:

"Plaintiffs' assertion of a new 'fundamental right' to produce, obtain, and consume unpasteurized milk lacks any support in law." [p. 4]
"It is within HHS's authority . . . to institute an intrastate ban [on unpasteurized milk] as well." [p. 6]
"Plaintiffs' assertion of a new 'fundamental right' under substantive due process to produce, obtain, and consume unpasteurized milk lacks any support in law." [p.17]
"There is no absolute right to consume or feed children any particular food." [p. 25]
"There is no 'deeply rooted' historical tradition of unfettered access to foods of all kinds." [p. 26]
"Plaintiffs' assertion of a 'fundamental right to their own bodily and physical health, which includes what foods they do and do not choose to consume for themselves and their families' is similarly unavailing because plaintiffs do not have a fundamental right to obtain any food they wish." [p. 26]
FDA's brief goes on to state that "even if such a right did exist, it would not render FDA's regulations unconstitutional because prohibiting the interstate sale and distribution of unpasteurized milk promotes bodily and physical health." [p. 27]
"There is no fundamental right to freedom of contract." [p. 27]

It is more important to target
raw milk, a favorite beef of theirs.

"We're supposed to have the world's safest food supply but we're letting in boatloads of this adulterate­d honey that all these other countries know is contaminat­ed and FDA does nothing."

The food safety agency said it's doing the best it can with existing resources and will do more when the newly passed Food Safety Modernizat­ion Act is up and running.

Reorganize Rawesome and get the
milk flowing again.

Who owns those 40 goats?
I thought it was the Rawesome private club.

Time to learn to tend our own goats.

Find out the rules, and see what it will take
to get this done. Begin to make allies
with LA city and county officials.

This is a great opportunity to educate,
listen and learn from each other.

Police our selves.

Regarding the Goats:

Find another place to have them.

Make sure we have pasture fed grass
where possible. Make sure we are using
organic feed.

We have major work on our hands to produce
organic alfalfa. If we do not come together
now and find ways to listen to each other,
with a short while we will all be impacted with
GMO alfalfa. If we do not come together now,
the USDA will continue on its path of
allow the deregulation of all Genetically Engineered
foods.

They have already given in to the deregulation
of common lawn grass. In other words, common
lawn grass is now o.k.ed to be GMO.

The consequences of this will be astounding.

We have gone as far down as we can go.

We all have to find ways to come up together.

GMO's need to be labeled and we have reached
a Tipping point. All that is holding this up now
is our infighting and recogniition that from
grassroots to organic stakeholders, we are called
to be on the same team.

An entire Education of Washington on Real Food Safety
needs to start now.

We need open Dialogue on Science, Ethics, and Food
between all factions of agriculture.

All voices need to be heard.

The FDA cannot be the enemy.
I am not opposed to having an FDA.
I simply want to a voice educating the FDA.
The FDA is now under the influence of big pharma
and big agriculture. This are bankrupt systems
that cannot survive the Shift that is being asked
of each of us now.

If left alone, cities such as San Diego
where I live, and many others, can model to Washington D.C.
what we need to do to Survive This Day and thrive
economically.

We are all in for a Wake Up Call.

Rawesome, I learned from watching the spoof
on Raw Milk, stands from "Awesome" with an "R" in front of it.
James Stewart said that to Stephen Colbert.

We all need to be Awesome now.
Some can eat raw, some are vegans.
Some of us deserve the best quality of
pasteurized milk possible, if that is our choice.
That means organic milk.

Each person has a right to choose and receive an honest
education about the choices.

All the education we need is already on the books.
It is in the books of Dr. Bernard Jensen and so many other
of our health elders, past, present, and future.

There are good people throughout the ranks of government.
There are good people who are standing up now to educate
about private rights and personal property.

The healthy world we are building asks we each
be an Organic Uprising, Standing Up for Nature's Original Technology.

The earth already has a perfect technology.
It is time to rediscover that technology.

We have--most of us--lost our beat with nature.
We are making poor decisions.

No one is without fault.
No one among us here has not made errors in judgement.

We all need to be accountable, as best we can,
and forgiving.

Begin to grow some of your own food.
Do what you can to get your beat back with nature.

Glad all these issues are coming to the surface to be looked at now.
Healthy prepared raw fresh milk, especially from raw goat’s milk, under sanitary conditions, or prepared as healthy fermentation processes,   can be health building.   Producing commercial milk from factory farmed animals who are uncared for, leaves a person increasingly open to disease.
Pasteurization is no cover up  for bad production methods.  Mistreated cows are a source of increasing outbreaks of disease. You can't mistreat cows, give them antibiotics, and expect not to reap the present harvest of antibiotic resistant strains of bacteria and more that are now rampant--MRSA. We are all in for an education.  If we start listening and hearing each other, we will come out the other side  with a healthier society. My updates are on the Plant Your Dream Blog.

Thomas Bloch's wife, Victoria was arrested today for allegedly selling raw milk. Bail was set at $60,000 for Victoria.
she is now out of jail as of August 5.
Gag order. She cannot speak about the case, according
to Mike Adams as of today.

James Stewart, owner of Rawesome, a private organic food buying club, was also arrested, along with Sharon Palmer, owner of Healthy Family Farms.
They are still in Jail, as of August 5, 4:52 pm.

We are rallying because Rawesome is operating according to law as a co-op, and are being charged as if they are a private business, which they are not. Co-ops nationwide are in fear for their own situations. If a legally-operating co-op is being raided like this, what does it mean for other co-ops across the nation? There is a private entity behind this who has a particular interest in shutting small farms down. (Most likely commercial agriculture, dairy, and other food production.)

RAWESOME Raw Food Buying Club in Venice Beach, California was raided for the second time today and James Stewart, club organizer, is in jail with $123K bond set. Victoria Bloch, a Weston A. Price chapter leader, and farmer Sharon Palmer were also arrested.

Mark McAfee of Organic Pastures Dairy is organizing a protest rally tomorrow morning at 8 a.m. at the courthouse where the raw milk advocates are to be arraigned. Southern California citizens are urged to join Mark McAfee and food blogger Ann Marie Michaels.

Arraignment is scheduled for tomorrow in Department 30, Los Angeles Superior Court, fifth floor, Criminal Justice Center, 210 W. Temple St., Los Angeles. Court opens at 8:30 a.m. The district attorneys office says it is likely they are to go before the judge during the morning session.

Share Agreements

Cow Shares, Herd Shares, Farm Shares

In states where dairy regulations forbid consumers their constitutional right to purchase raw milk in stores or directly from farmers, consumers are entering into share agreements with the farmer.

In a cow share or herd share agreement, consumers pay a farmer a fee for boarding their cow, (or share of a cow), caring for the cow and milking the cow. The cow share owner then obtains (but does not purchase) the milk from his own cow. This arrangement is similar to arrangements of owning a share in a racehorse or a bull.

Some states, such as Wisconsin, actually forbid cow share agreements (which represents a further abridgement of our constitutional rights.) In these states, consumers and farmers have set up corporations in which consumers hold non-voting shares. This permits the consumer to obtain raw milk and other products from the farm in which he shares ownership (a farm share). It is more difficult and more expensive to set up a farm share program than a cow or herd share program, but this arrangement has the advantage of providing the farmer with more protection.

and private food club owner arrested for selling fresh milk

About 20 armed agents from various local, state and federal agencies coordinated by the US Food and Drug Administration staged another raid on fresh foods sold in California at a Ventura County farm and at Rawesome Foods, a private buying club providing members with unadulterated, unpasteurized milk and dairy products, among other items.

Healthy Family Farms owner Sharon Palmer and one of her employees, Eugenie Bloch, were arrested, along with the Venice, California club Rawesome Foods operator, James Cecil Stewart.

A protest is planned for tomorrow’s arraignment hearings (Thursday, August 4) at Los Angeles Superior Court, Criminal Justice Center, 210 W. Temple Street. Organizers are asking protesters to arrive at 7:45 am.

The FDA raid inclFDA raid included agents from the California Franchise Tax Board; the CA Department of Food and Agriculture’s Milk and Dairy Food Safety Branch and the department’s Division of Measurement Standards; the Los Angeles County District Attorney’s Office; the LA County Dept. of Public Health; the Ventura County Sheriff’s Department, the Ventura County Dept. of Public Health; the LA Police Department and the LA Dept. of Building and Safety.

Palmer is charged with nine counts of criminal conspiracy and operating without a license, while Stewart is facing 13 counts.

This latest arrest marks the fourth raid on Sharon Palmer, who has been continually harassed for providing products that humans have consumed for thousands of years, but which now is regulated under laws designed to put the small fresh food operator out of business and promote the profits of the genetically modified, drugged, adulterated product of Big Dairy.

Agents stole computers, business records and thousands of dollars in product from these honest, hard working citizens, whose products have sickened no one.

This is the second raid on Rawesome Foods, following the international scandal last year when jackboot thugs with badges broke into the private premises with their guns drawn.


9.4 MILLION DRINK RAW MILK
42 GOT SICK
REPORT SAYS

The raid follows a recent report by retired pathologist Ted Beals, MD, based on Centers for Disease Control numbers, which revealed that an estimated 9.4 million people drink raw milk in the US, while 42 get sick each year from contaminated product. This amounts to six-millionths of a percent who become sick from raw milk.

BUT FDA IS GONG AFTER LITTLE FARMERS

Contrast that with the whopping 16% in foodborne illnesses each year in the U.S., according to CDC figures. Yet, the FDA is not shutting down food production at factory farms or food processors where contamination originates. Nor does it steal its products and computers. For example, Jack DeCoster continues to operate sick egg factories despite decades of illness, employee abuse, and food safety violations.

Dr. Beals delivered his findings at the Third International Raw Milk Symposium on May 7, 2011 in Bloomington, Minnesota. In comparing all foodborne illnesses with just that from raw milk, he notes:

"That data showing illnesses come from a 2011 publication compiled by a team of researchers at the CDC FoodNet Surveillance Center. The paper, by Elaine Scallan and others, is entitled Foodborne Illness Acquired in the United States—Major Pathogens" and was published in Emerging Infectious Diseases. The model does include a factor for unreported illnesses, but it revised downward the figure of 78 million foodborne illnesses per year that government agencies have been using in the past. Instead the report estimates that 48 million Americans are sickened each year from all agents, including viruses, bacteria and toxins, in all foods. That is one out of every six people. The numbers given in the report are based on their most up-to-date information which was for the year 2008. Their data:

Let there be no doubt that the federal government is intent on destroying the health food industry by criminalizing foods and supplements that have not been genetically modified, processed or adulterated with nanoparticles, chemicals or drugs. They serve their corporate masters in the pharmaceutical and agro-industrial sector, who profit from making us sick.

Defend these fresh food farmers and suppliers. Attend the protest if you can, support local foods that are produced safely and humanely, and write your local media and legislators about these unconstitutional attacks on your right to eat food of your choice.

Mark McAfee of Organic Pastures Dairy is organizing a protest rally tomorrow morning at 8 a.m. at the courthouse where the raw milk advocates are to be arraigned. Southern California citizens are urged to join Mark McAfee and food blogger Ann Marie Michaels. Arraignment is scheduled for tomorrow in Department 30, Los Angeles Superior Court, fifth floor, Criminal Justice Center, 210 W. Temple St., Los Angeles. Court opens at 8:30 a.m. The district attorneys office says it is likely they are to go before the judge during the morning session.

Why, one may ask, is the government so intent on shutting down raw milk producers and sellers? The stated reason is always that raw milk may contain harmful bacteria, which is true but irrelevant. As Congressman (and medical doctor) Ron Paul put it, “If we are not even free anymore to decide something as basic as what we wish to eat or drink, how much freedom do we really have left?”

Besides, from a constitutional standpoint, it’s certainly none of the federal government’s business. If anyone should be policing what Healthy Family Farms produces and Rawesome Foods sells, it’s the state of California and the local jurisdictions in which those businesses reside — and their law enforcement agencies, without the encouragement of the feds, would probably not waste their time and taxpayers’ money on such trivial things.

There are two far more plausible reasons for the war on raw milk, neither of which has anything to do with our rulers’ supposed concern for our health. First, as the Times astutely observes, “demand for all manner of raw foods has been growing” — a threat to “the politically powerful dairy industry,” which “has pressed the government to act.” Second, it’s about asserting power over individuals. The San Jose Mercury News writes that one of the allegedly incriminating pieces of evidence turned up in the raid on Rawesome was a membership agreement stating that the prospective member will “completely reject and refuse all governmental standards ... any governmental sanitation standards for food storage and display.” As Joanne Whittle, a Rawesome volunteer remarked, “I guess that’s their bone of contention, that they can’t control us.”
