By a 212-206 vote on December 8, the House passed the FDA Food Safety Modernization Act (formerly S.510) as an amendment to H.R. 3082 (the "Full-Year Continuing Appropriations Act, 2011" to fund the government through September 2011). A food safety act should not be part of a spending bill.

House Democrats attached what was S.510 (as passed by the Senate on November 30) to H.R. 3082 because they were worried about Republican opposition to it as a stand alone bill. The next step for H.R. 3082 is to go to the Senate for a vote.

As this is the Senate, the first vote on H.R. 3082 will be on a cloture motion to limit debate before there is a vote on the bill itself.

TALKING POINTS

The FDA Food Safety Modernization Act is fundamentally flawed and is not in the best interest of small farmers, especially those who produce raw milk.

1. FDA does not respect individuals' rights to obtain healthy, quality foods of their choice. The agency has stated, as a matter of public record, that:
"There is no absolute right to consume or feed children any particular food."

"Plaintiffs' assertion of a 'fundamental right to their own bodily and physical health, which includes what foods they do and do not choose to consume for themselves and their families' is similarly unavailing because plaintiffs do not have a fundamental right to obtain any food they wish."
FDA has even participated in armed raids on small-scale co-ops and membership organizations. This agency should not be given any additional power.

2. FDA has adequate powers under existing law to ensure food safety and effectively deal with foodborne illness outbreaks. FDA has power to inspect, power to detain product and can readily obtain court orders to seize adulterated or misbranded food products or enjoin them from being sold. The problem isn't that FDA needs more power; it's that FDA does not effectively use the power it currently has. The agency has power to inspect imported food yet inspects only 1% of food coming into this country from outside our borders.

3. S.510 does nothing to address many significant food safety problems in this country, such as those resulting from confined animal feeding operations (CAFOs), genetically modified organisms (GMOs), and various contaminants (e.g., BPA, pesticides, herbicides, etc.).

4. FDA has used its existing power to benefit the pharmaceutical and biotechnology industries at the expense of public health (e.g., allowing the overuse of antibiotics in confined animal feeding operations and refusing to require labeling for genetically-modified foods). This bill does not address the fundamental problems at this agency in order to truly protect public health.

5. S.510 will expand FDA's involvement in regulating food in intra-state commerce, further interfering with local communities. State and local governments are more than capable of handling any problems related to food in intrastate commerce. All the major outbreaks of foodborne illness involve either imported food or food in inter-state commerce.

6. S.510 will hurt our ability as a nation to be self-sufficient in food production because it has more lenient inspection requirements for foreign than domestic producers creating an unfair advantage for food imports. Giving an advantage to foreign producers will only increase the amount of food imported into this country that does not meet our domestic standards. S.510 does not address food security--the ability of a country to produce enough food to meet its own needs.

DeMint threatens to force a reading of omnibus bill

The year-end legislative push appears threatened by procedural hijinks on the Senate floor.

As Democrats try to push through a nearly 2,000-page omnibus spending bill, Republican senators are threatening to bog down the floor by forcing Senate clerks to read the full text aloud, a process that could take more than one full day to complete.

“Democrats haven’t given Republicans or the American people time to read the bill, but I’ll join with other Republican colleagues to force them to read it on the Senate floor,” said Sen. Jim DeMint (R-S.C.).

Such a tactic is rarely employed, but any senator can force a full reading of legislation, which is usually skipped by unanimous consent.

During the health care debate last December, Sen. Tom Coburn (R-Okla.) forced clerks to read aloud Sen. Bernie Sanders’ (I-Vt.) 767-page amendment to establish a single-payer system. Sanders withdrew his amendment several hours into the reading, which had effectively paralyzed the Senate.

With the window closing on the 111th Congress, forcing a reading of the omnibus spending bill could further extend the lame-duck session until the end of the year, or force Senate Majority Leader Harry Reid to scale back an ambitious agenda, which includes a repeal of the “don’t ask, don’t tell” policy, ratification of the START treaty, confirmation of stalled nominations and a vote on an immigration bill known as the Dream Act.

I am sensitive/allergic to many chemical compounds and commercially produced foods (get bad headache/stomach problems for days, have to take antihistamines, which can progress to full anaphylactic shock in its most serious phase-I have an Epipen for that), so I NEED to eat foods that are as naturally produced with no chemicals etc. as a matter of LIFE and DEATH for me. I was born and raised on a farm in the great state of Idaho. I grew up drinking whole, raw foods and whole, raw milk and have turned out to be healthy and even smart, just look at my college GPA and work history. Interestingly enough whole raw foods may be why I am alive today.
I am now a registered nurse and care for many patients that are extremely ill due to the modernization of food products through multiplies levels of food processing. Many of these individuals who I care for have severe immune deficiency's and are generally on deaths door step when I care for them. Many of these patients are victims of Myocardial Infarctions more commonly known as heart attacks. Again with heart attacks the research points to processed foods and consumption of the wrong types of oils, such as seed oils that our body cannot process adequately. Much of this research is not new but unfortunately continues to be ignored due to the fact that the information threatens large corporation's incomes.
Many of you would question my statements as the relation to processed food consumption and health, but it does not take a PHD to know and understand this from the most basic level. Just pay attention next time to how you feel after eating a burger and fries, or if you like eat as healthy as possible meaning eliminating as many processed foods as possible out of your diet for two weeks, then eat the burger and fries that are "safe" food to consume. After eating evaluate how you feel.
That said it is every American's right to choose how to be healthy be it through raw whole foods or through following or not following government or medical advice. It is each individual's choice, not the government's choice to be healthy. If we all follow the government's advice as to be healthy we will find that America's health will become worse than it already is!
Please remember that the land of the free means: free chose to be healthy or to be sick! That also means we are also free to suffer the consequences of our actions!

Food Safety needs to be addressed appropriately and directly--not cloaked in a spending bill, the current version of the FDA Food Safety Modernization Act still fails to get to the root problems in the U.S. food supply and gives FDA a blank check to continue to run amock over small producers. FDA needs to be held accountable and answerable for its failures to exercise the powers it currently has. The food safety bill needs to focus on the large corporations who are continually the source of the major multi-state food outbreaks. Our best defense is to decentralize food production and not pass laws that essentially favor imports. FDA cannot be trusted to act in the best interest of America's public health as proven repeatedly by its bias toward pharmaceuticals and refusal to rein in GMOs.
Vote "No" on cloture on any bill containing the Act and then Oppose the Act until the real issues are addressed. A bill that 'bites off more than it can chew' fails to serve the American people.

The passing of H.R. 3082 is a clear example of the lack of oversight and communication so characteristic of our government, generally, and leaders specifically. Further, lack of Agency accountability has become a great concern within the past decades and the passing of this bill ensures this trends' continuation. Without the disease itself being treated, but the symptoms alone, there can never be true progress and change within our system and, ultimately, health. How can there be when one USDA/FDA inspection alone cost the state of Florida $350 million due to an incompetency erring the discovery of salmonella in the wrong produce? And there still has been no oversight hearing to account for this. This Bill disguises the real problems Washington does not have the gall to face up to for any number of reasons. The continuation of this deceit and ignorance is going to leave this country in totalitarian ruins in the years to come. It is time to do something NOW, before it is too late.
