Fate of Rare Fruit Tree Legacy to be Determined 11-19 at Vista Court House

The fate of thousands of exotic rare fruit trees
will be determined in the Vista CA Court house at 8:10 AM,
325 S Melrose Dr, #100, Vista, CA 92081, November 19.

A gathering of supporters, willing tree buyers,
and press outside the court is in order.
What is needed now are firm
commitments to buy trees, sales,
and ”Angels” who will step forward and lend money.
$50,000 in needed to
pay back rent and lawyer fees that would
create a ”stay of execution”
for the priceless heritage of genetic biodiversity.
The estimated value of the trees are
1.3 million. Spanglers’ court strategy
is to show the judge he can raise $150.000
in the weeks or months ahead
with a plan of action.


STEVEN SPANGLER, lease holder of the property
is asking the court is to allow for extra time
to raise money to pay off back rent owed,
and give time for an emerging support network
of community individuals, groups, and FACEBOOK
members time to organize a campaign
to raise funds to purchase the five acres
of the Exotica Rare Fruit Nursery.

The fate of one of San Diego County's--if not the nation's richest sources of genetic biodiversity-- will be determined at the Vista Court House, November 19, at 8:10 AM. The outcome of 15 minutes before the judge will in all likelihood seal the fate of thousands of the rarest of exotic nursery stock--some one-of-a kind trees--unknown to commercial nurseries.

The case involves a simple tree grower, STEVEN SPANGLER, who in attempts to preserve his business, the EXOTICA RARE NURSERY FRUIT Nursery--about seven years ago--signed an agreement with an ally PAUL PANCRITIUS. In an act of good will, Pancritius stepped forward to bail Spangler out of a tight money situation and need to secure a new ownerof the property. In an apparent verbal contract between friends, Pancritius gave more than $345,000 dollars to rescue the nursery from the old owners who wanted to sell. Pancritius became an ally of the trees, gave the money, as Spangler reports. The intent was to allow Spangler to continue his unique business on the property. However, against the ticking of a clock eight years ago, when moments counted between eviction and staying on the land he had cared for since the early 90’s, Spangler, although protesting, signed an agreement drawn by a lawyer, that not only gave Pancritius the ownership of the land but the ownership of the trees. The trees are valued at 1.3 million. From a botanist’s point of view, the three-acre parcel, located technically in Bonsall, is priceless. It is a legacy of rare fruit and nut bearing trees intended as a legacy to future generations. Spangler, the leasee of the three acres for more than 20 years--today has land filled with pecan trees and 1000's of pomegranates that now go many feet into the sky.

Many of the specimens are endangered plant species
collected by Spangler through his expeditions
to distant parts of the world during his youth.
Spangler is now 57.
He is one the world’s true plant wisdom teachers,
and a protegee of the late PETER DUKICH,
an international father of the biodynamic food growing movement.


EMERGING COMMUNITY SUPPORT

Spangler, spoke before the weekly 4-5:15 pm meeting of the ROOTS SUSTAINABLE FOOD PROJECT ACTION COMMITTEE November 16 at the OCEAN BEACH PEOPLE’s FOOD COOP, San Diego’s most celebrated community run organic food store. He drew widespread interest. Attendees at the Roots meeting represent a cross section of students, non-profits, and individuals invested in the bright green future of a sustainable San Diego.



OPTION TO BUY--$350,000

The option to buy jeopardized three acres, and prevent
possible sale to another owner, is $350,000. Seven years ago, when the three acres were last threatened,
owners wanted to build mini-storage units
where the trees now stand.

WILL THE JUDGE RUBBER STAND THE EVICTION
NOTICE NOVEMBER 19?

If the judge rubber stamps the eviction notice on Thursday--a high possibility that will occur if concerned citizens do not take action now--Spangler will be served a notice to quit the property. PAUL PANCRITUS, landlord, who is currently ill with cancer, and his heirs will take possession of all the trees on the three-acre parcel.

OUT OF ORDER SERVING OF THE EVICTION NOTICE

Spangler points out numbers of miniscule issues that
a lawyer representing him could present before the judge,
if he had money to be represent. The original eviction notice was mis-served to an erroneous address by the marshall’s office,
delaying the time he had to respond.
Spangler will go unrepresented before the judge, while
the the Pancritius family will have a lawyer.

In the original agreement drawn up
by the Pancritius lawyers years ago,
Spangler paid out thousands to the
previous owner but never received any equity. He also
paid thousands in lawyer fees. Under duress, he agreed
to pay more than $2600.00 in month rent. The money
he raised from the community covered his first year’s rents,
and represented many thousands of dollars.


BUSINESS OPPORTUNITY
and NON-PROFIT FUTURE?

Spangler is also open to business partners
for the Exotica Rare Fruit Nursery.
Among the ideas circulating now are
for the entire five-acre parcel to be managed
by a non-profit, a foundation, a University,
a Museum, or end up eventually as
a county-wide park or botanical museum.
There is no question that this land is a public
treasure of priceless value to botanists worldwide
and that its perservation is an issue of homeland
security and food safety. Monoculture, that breeds
a lost of biodiverse materials, has at times in history
brought nations to the point of famine. What we have
here is a source of vast botanical plant material.
Spankler, on the outs with back rent payments,
is as well to be commended for his service to humanity.
His noble work needs to be underwritten, while
he maintains the business that has generated
positive cash flow for most of its existence.

Spangler would like to continue to do
business on the site for the remainder of his life,
and this is the highest land use.

Spangler, a langy tree farmer and world explorer,
appears more suited to tend the trees, pass along
his enormous body of plant wisdom, then tend
the daily business operations.

two-acre parcel leased by Spangler.
