Cities and Counties Cannot Issue Citations!

I find additional relief in knowing this about the California Penal Code!

For a couple years since I first heard that the City of San Diego could possibly fine a property owner for violating the recycling ordinance I had taken that rather seriously and would clean out the unacceptable items from our blue bin/s on an on-going basis. In the process of doing that I would also condense the volume that typically filled up our containers. Then a couple weeks ago our house manager invited me to discontinue doing that and I immediately accepted! However I also had to let go of any concerns I had regarding the possibility of some kind of action by the City for any alleged violations. Now reading the following Penal Code reference I am more completely relieved of my concerns! I also had taken in concerns of another housemate over possible issues regarding sanitation and/or fire hazards that he thought could draw the City's attention and now all of that is no longer my concern! It's a relief!

Cities And Counties Cannot Issue Citations -

California Penal Code, Chapter 5b CITATIONS FOR VIOLATIONS OF COUNTY, CITY OR CITY AND COUNTY ORDINANCES. Sections 853.1 through 853.4. Enacted 1955. Repealed 1967. It has been illegal since 1967 for city or county ordinances to be enforced on private property. County employees are committing domestic terrorism if they issue “citations” for “code violations” on private property. “Repealed” means CANCELLED SINCE 1967. Twelve years of lawsuits between the years 1955 and 1967 clearly established the unconstitutionality of “city and county CITATIONS,” so they were ABOLISHED. Any city or county employee writing one after 1967 is guilty of racketeering, extortion, and terrorism. The penalty is four years in prison.[1]
