Why is everyone so surprised?
[1] Judge Susan Bolton is a federal judge. By definition that makes her more liberal than the average American;
[2] She was appointed by Bill Clinton, which moves her leftward from the average federal judge;
[3] Federal officials at all levels and in all branches are interested in holding onto their power.
[4] The hubris of the federal courts knows no bounds: The Supreme Court routinely amends the Constitution and overrides laws passed by Congress. It has even given the lower federal courts the power to levy taxes--a power the Constitution gives exclusively to Congress--and more particularly, tax bills must originate in the House of Representatives. But in Missouri v. Jenkins, Justice Kennedy excoriated his colleagues on the Court for their extending the power to tax to the federal courts, even while agreeing with the outcome in this particular school desegration case.. He wrote,

"Today's casual embrace of taxation imposed by the unelected, life-tenured Federal Judiciary disregards fundamental precepts for the democratic control of public institutions. I cannot acquiesce in the majority's statements on this point, and should there arise an actual dispute over the collection of taxes as here contemplated in a case that is not, like this one, premature, we should not confirm the outcome of premises adopted with so little constitutional justification. The Court's statements, in my view, cannot be seen as necessary for its judgment, or as precedent for the future, and I cannot join Parts III and IV of the Court's opinion."
