December 16, '11 Update re:

Was the "hit" Organic Pastures took because they have been strictly following the regulations from the state regulators?h

"Access to raw milk across North America is volatile."
(And possibly more volatile if the dairy is licensed by the State!)

Here are just a few activities that currently pose a potential threat to raw milk:

2010 “The Food Safety Modernization Act” gives the FDA new authority to shut down raw milk dairies without Due Process.

The California Milk Pool fees unfairly suppress raw milk production with a horrendous tax burden that increases consumer costs at an alarming rate.

The biased and unfair reporting of CDC data which refuses to list deaths from pasteurized milk products even though there is proof that is a matter of public record like the Jalisco Cheese incident in 1985 when pasteurized cheese killed at least 50 people.

There is an organized alliance of those who oppose the legalization of raw milk and have stated their intentions to end consumer access to raw milk. Their strong political voice is also financially backed. Until now, raw milk has lacked a strong unified voice to defend.

Finally, there is an organization that will give raw milk that voice. OPDC is pleased to introduce you to the Raw Milk Institute; a politically engaged, research organization dedicated to the protection of raw milk.

In California we have enjoyed free access to raw milk at grocery stores, co-ops, and farmers markets for years but that is not the case in all states. Every state has different laws, different standards, and different ideas about raw milk. The FDA has thrived on the inability for states to be able to work together and form a clear voice for raw milk. Raw Milk Institute is that voice.

Organic Pastures believes that the existence of the Raw Milk Institute is critical. Let’s create unity where the FDA encourages chaos; let’s help consumers connect to farmers; lets help farmers produce the best, safest raw milk; let’s give regulators a clear picture of who WE are; and lets help give legislation oversight to provide access to safe raw milk. Let us stand united at a forefront of a time of change for raw milk. Our voices together make an indescribable splash in the raw milk world.[2]

I'm beginning to feel the power of this and it feels so good!

November 21:
CDFA Raw Milk Recall
UNFOUNDED

"The California Department of Food and Agriculture and the California Department of Public Health have recalled Organic Pastures raw dairy products as of Tuesday, November 15th. This recall came just two days after Mark McAfee, founder of Organic Pastures Dairy, announced the launching of the Raw Milk Institute. The announcement was made at the closing ceremony of the Weston A. Price Annual Conference in Dallas, Texas Sunday, November 13th.

Over the course of an eight-week period earlier this year, five people tested positive for E. Coli O157:H7; these five consumers reported drinking raw milk. What the CDFA seems to forget is that there are numerous sources of E. Coli 0157:H7 and that it's occurrence in raw milk from truly pastured cows is non-existent. In 2000 Organic Pastures Dairy Company became California's first raw milk dairy with certified organic pasture land. Since that time, Organic Pastures raw milk has always tested negative to pathogens. The CDFA knows this.

According to the California Department of Public Health, all products collected from the ill patients have been negative for E. Coli 0157:H7. The CDFA tests all Organic Pastures' products every month for pathogens. Organic Pastures also uses a third- party for pathogen testing multiple times per week. All these tests have been negative. The CDFA samples of manure from Organic Pastures Dairy have also tested negative for pathogens.

Let the CDFA know you are not happy with their hasty actions in recalling raw milk. This is a costly and irresponsible waste of our tax dollars.

No pathogens found and yet they recall the milk during Organic Pastures' biggest week of the year? Something's rotten in the state of California. As the consumption of raw milk continues to increase and profits from commercial, denatured grain-fed, pasteurized milk drop nationwide, politics enters our food choices. Please stand up for our rights to nutrient dense food.

I made the following comment at a great site:

"Finally, a clear and undiluted voice that speaks to the core truth of this issue! The relationship that each and every single American has with the current governmental entities by whatever stripe or color-of-law they may be operating under!:

'... if you want to protect and preserve your rights, you have to stand up for your rights when the government violates them because this is your role and responsibility in a republic.'

Indeed! That is at the very minimum! One can only preserve what they know they have. The truth is that we can truly have more Rights than we have been led to believe. To "protect and preserve your rights" take an inventory on what you "know" and then see if that compares with the likes of Thomas Jefferson and the sources he drew from!

For those who have the ears to hear: don't wait till 'when the government violates them'! First of all they have already violated them in distorting the truth about the Law! That is another good reason to know the truths that the founding fathers like Thomas Jefferson knew! IMHO there is an urgent need to stand up for your rights before the government violates them! You have the Right to reserve your Rights in every single instance of participating in a governmental 'scheme' and anything that has a governmental connection to it. And nowadays that appears to be most anything! I could go on but, hopefully, you get the idea!

Addressed to specific governmental agents and/or to the agency as a whole:

'Under what law or theory of law do you intend to claim limitation, exemption or immunity from personal liability for your acts, actions or failure to act under a known duty as they specifically apply to me and to my unalienable Rights, my office and the Estate?

Who is going to indemnify me from your tortuous interference in my private affairs and trespass on me and my estate?

I will need to see your delegation of authority, your oath of office, bond and/or liability insurance and a copy of the contract with which you think you may have claim or authority over me, my office or estate.

Any Trespass on this estate is subject to one million dollar ($1,000,000.00) indemnification for each act and is immediately due and payable and is agreed by you to a consensual lien against all of your assets if not paid in full within 72 hours of each act of trespass.

Notice to Agent is Notice to Principal, Notice to Principal is Notice to Agent.'

If the agency's presentment is onsite then the response can include:
'You are dismissed and are hereby ordered to leave now.'

Finally: 'This matter is adjourned!'

Please feel free to circulate the above example of how one American would respond to protect himself from this kind of an offer by the USDA. In addition, I would also do like farmer John demonstrated in 'The Real Dirt on Farmer John' and post No Trespassing signs with the additional warning to USDA agents and ideally including a copy of the above."
